Aerosmith singer Steven Tyler is accused of sexually assaulting a former teenage model twice in one day in Manhattan nearly 50 years ago.
On Wednesday, a US judge dismissed the complaint and told Jeanne Bellino, the alleged victim, that she waited too long to sue the 75-year-old singer.

According to reports, Judge Lewis A. Kaplan told Bellino that because he did not allege that Tyler’s actions constituted a “risk of serious physical injury,” he was ineligible for a two-year period to pursue a claim that would otherwise run outside the statute of limitations.
Additionally, Judge Kaplan determined that Bellino’s claim was preempted by the Child Victims Act and the Adult Survivors Act “substantially for the reasons” noted by Tyler’s attorney.
Tyler’s attorneys further claimed that Bellino showed a “lack of diligence” by choosing not to file a lawsuit under the Child Victims Act. They state that the statute whose statute of limitations has been passed “occupies the area concerning the revival of claims derived from state criminal sexual assault statutes.”
Following the court’s decision, Tyler’s lawyer, David Long-Daniels, said, per Reuters“We agree with the judge’s reasoning and are grateful for this decision on behalf of our client.”
It is a very important decision, and it is not known how Judge Kaplan’s precedent will affect other cases brought in New York City under the same statute in the future.
Bellino now reportedly has until March 13 to amend his complaint.

In his lawsuit filed last year, Bellino claims that in 1975, when he was 17, a friend asked him to meet the band Aerosmith after a fashion show in Manhattan.
She claims that while Tyler, then 27, and his group were walking down the street together, he pushed her into a phone booth and proceeded to grope her, simulate intercourse, and shove his “tongue down her throat” while others laughed.
According to the lawsuit, “the others stood outside the phone booth laughing, and while passersby watched and witnessed, no one in the group intervened.” Bellino also mentioned that he was abused by Tyler again when he went to the Warwick Hotel with the group.
She claims in her lawsuit that the incident caused her “severe pain of mind and body, severe and permanent emotional distress, physical manifestations of emotional distress, embarrassment, humiliation, physical, personal & psychological injury.”
Tyler reportedly “vehemently” denied Bellino’s claims.
