Actor Alec Baldwin is now suing the “Rust” crew in the latest legal development from the Western movie set.
More than a year ago, cinematographer Halyna Hutchins was killed and director Joel Souza was injured when the gun Baldwin was holding discharged. The “30 Rock” actor has claimed several times that he did not pull the trigger on the gun, which contained live ammunition.
How the bullet ended up on the movie set is the subject of a police investigation that was recently turned over to the District Attorney’s office for possible criminal charges.
Although the Hutchins family settled their wrongful-death lawsuit against the producers of “Rust” — including Baldwin — the actor has now turned around and sued the crew alleging negligence.

Although Los Angeles Superior Court was closed Friday for the Veterans Day holiday, Alec Baldwin still slapped “Rust” with a negligence lawsuit on Friday, November 11.
The negligence and damages lawsuit names “Rust” armorer Hannah Gutierrez Reed, first assistant director David Halls, real estate magnate Sarah Zachry, and gun and ammunition supplier Seth Kenney — and his company — as defendants in this new lawsuit (via Deadline).

In a counter-complaint from Baldwin’s lawyer, Luke Nikas, the “Beetlejuice” actor laid the blame for the tragedy on another crew member who failed to properly check the gun for live ammunition before a training scene.
“This tragedy occurred because live ammunition was delivered to the set and loaded into the gun, Gutierrez-Reed failed to carefully inspect the ammunition or the gun, Halls failed to thoroughly inspect the gun but declared it safe before handing it to Baldwin, and Zachry failed to disclose that Gutierrez-Reed has acted recklessly off set and is a safety risk to those around him.”
The counter-complaint also states that Baldwin was “fired from multiple jobs” due to “incidents” on the set of “Rust.”
“Baldwin has also lost numerous employment opportunities and related income,” the complaint states. “For example, he was fired from various jobs expressly because of the incident in Rust and was let go for other opportunities, which was a direct result of the negligence of Cross-Defendants Gutierrez-Reed, Halls, Kenney, PDQ, and Zachry.”

“More than anyone else on the set, Baldwin has been wrongly attributed as the perpetrator of this tragedy,” Baldwin’s attorney wrote. “Through this Cross-Claim, Baldwin seeks to clear his name and hold the Cross-Defendants accountable for their wrongdoing.”
“It cannot be denied that others have suffered far more from Cross-Defendant’s negligence than Baldwin,” the lawsuit states, adding:
“Hutchins lost his life, and his little boy lost his mother. Producer Joel Souza was shot in the shoulder and has suffered physical and emotional pain. Although not comparable, Baldwin must live with the immense grief, and resulting emotional, physical, and financial consequences, due to the fact that the negligent conduct, assurance, and supervision of the Cross-Defendant put a loaded gun in his hands and lead. he, Hutchins, and everyone on set to believe that the directed use of the weapon was safe.”
Baldwin Is Defendant In Separate ‘Rust’ Negligence Suit

This is not the only lawsuit that Baldwin is currently involved in. Baldwin is actually a defendant in a separate negligence lawsuit. The lawsuit was filed by “Rust” script supervisor Mamie Mitchell, who was standing next to Hutchins and Souza when the gun was fired.
Baldwin did not name Mitchell in the lawsuit Friday; however, attorney Gloria Allred is still responding to Baldwin’s new negligence suit.
“Baldwin’s counter-complaint is a shameful attempt to shift blame to others, just as he has done since he fired the fatal shot that killed Ms. Hutchins and injured our client, Mamie Mitchell,” Allred said. “He claimed that everyone was negligent and everyone else was at fault. Mr. Baldwin seems to be arguing that he is the only one who is truly innocent.”

“One last thing I want to say to you, Mr. Baldwin – take responsibility for your actions,” Allred continued. “I am not suggesting that others are also not responsible for what happened. However, if you look in the mirror you will see the person we believe is most responsible for what happened that tragic day on the set of Rust in New Mexico.
It remains to be seen whether Baldwin will be criminally charged for the “Rust” incident.
