President Biden is likely to be acquitted and face no criminal charges for his retention of classified material from his days as a US senator from Delaware.
Special counsel Robert Hur’s team is preparing a report on its months-long investigation, but is not expected to charge anyone in the matter, CNN and the Wall Street Journal reported Thursday.
The result was far from surprising, as the Justice Department has a long-standing policy against impeachment of a sitting president on the grounds that it would “undermine the capacity of the executive branch to perform constitutionally mandated functions.”
Hur, a former Trump appointee, was named special counsel by Attorney General Merrick Garland on January 12 to investigate the matter of Biden’s classified documents.
Almost exactly two months earlier, Garland had tapped Jack Smith as special counsel to investigate former President Donald Trump hiding national security material at his Mar-a-Lago resort.

Smith’s team has since slapped 40 charges against the former president in the case.
Biden sat down for voluntary interviews with Hur on at least two occasions last month, the White House previously confirmed.
As Hur’s investigation into Biden winds down, House Republicans have begun signaling plans to turn up the heat on the classified documents scandal.

Earlier this week, House Oversight Committee Chairman James Comer (R-Ky.) subpoenaed former White House counsel Dana Remus for information on the matter.
Comer led a three-committee impeachment inquiry into Biden that largely focused on the first family’s foreign business dealings.
Last month, Comer stated that his Oversight Committee was looking into the document situation and pointed to alleged gaps in the timeline of White House events.

In January, the White House confirmed that a personal lawyer for Biden found classified material in his post-presidential office at Washington’s Penn Biden Center for Diplomacy and Global Engagement the previous November, days before the midterm elections.
CNN reported at the time that around 10 classified documents, some marked “top secret,” were found and related to the United Kingdom, Ukraine and Iran.
Other classified documents were recovered from Biden’s home in Wilmington, Del. — where images from Hunter Biden’s abandoned laptop show a battered “Important Documents” box and show Hunter had access to the family garage where the documents were kept not far from where Biden’s 1967 Corvette Stingray was parked.
The White House did not immediately respond to a request for comment from The Post.
