On Wednesday, June 7, “Bob’s Burgers” actor Jay Johnston was arrested for being part of a “gang attack” on the US Capitol on January 6, according to court documents obtained by Deadline. The actor has been charged with “obstructing law enforcement from carrying out their duties, as well as misdemeanor entering a restricted area, and obstructing the course of government business.”
The investigation into his participation in the attack on the US Capitol first began in March 2021, when the FBI took action to Twitter to request information about the individual shown in the photo.

Some fans actually do not believe that the actor can play a role in Riot Capitol. One user commented, “I know it’s not him but this guy looks like Jay Johnston from the Mr. Show with Bob and David.”
Another user then replied, “It’s him.”

Another user added a GIF of Bob from “Bob’s Burgers,” saying, “D— you, Jimmy Pesto.” Johnston has voiced pizzeria owner Jimmy Pesto for dozens of episodes of the Fox animated series.
However, she has also appeared in other shows, such as “Better Call Saul” and “The Sarah Silverman Program.” However, in December 2021, at least two sources revealed that Johnston had been “banned” from the animated series due to his alleged involvement in the Capitol Riot.
According to Snopes, co-star Tim Heidecker said that it was “fully confirmed” through “reliable sources” that the man in the FBI tweet was Johnston, although the tweet has since been deleted. Snopes also reported that two other actors who starred with Johnston in the 2014 documentary “Harmontown” – Spencer Crittenden and Cassandra Church – came forward to say that Johnston had attended the rally and was a strong supporter of former US President Donald Trump.

According to the legal papers, “On or about March 8, 2021, an attorney contacted the FBI’s National Threat Operations Center (“NTOC”) and stated that he represented JAY JAMES JOHNSTON, who is the individual depicted in the publicly circulated photograph 247 -AFO.”
“The FBI has interviewed three current or former associates of JOHNSTON, all of whom identified JOHNSTON as the individual in the 247-AFO photograph above,” the document continued. “One of these associates provided the FBI with a text message in which JOHNSTON admitted to being at the Capitol on January 6, stating ‘The news has presented it as an attack. It actually isn’t. Thought it turned into that. It was chaos. There was maced and tear gas and I found it quite ineffective.’”
The court papers go on to say that “Records from United Airlines show that JOHNSTON has a round trip reservation from Los Angeles, California to Washington, DC departing on January 4, 2021, and returning on January 7, 2021.”

Many fans took to social media to share their thoughts on Jimmy Pesto’s sudden disappearance from the show. One fan thought they should turn the controversy into a storyline, called “Pesto Got Aresto Burger.” Another fan suggested the “Capitol Rye-it burger,” adding, “Comes with a side of 3-5 years.”
“Pesto was arrested for being involved in a riot on the 6th,” another fan suggested. “Jimmy’s brother took over but he didn’t know anything about running a restaurant. He goes to Bob for help and Bob helps and they become friends. Then something happens like they find there are only so many customers and they compete head to head no matter what and end up hating each other. The status quo is back.”
