Boy charged with fellow 10-year-old’s murder after taking gun from felon father’s car: cops

A 10-year-old Sacramento boy shot and killed another 10-year-old with a stolen gun he found in his criminal father’s car while taking a pack of cigarettes from the vehicle, authorities said.

Sacramento County Sheriff’s deputies charged the young man with murder and his father, Arkete Davis, 53, with multiple felonies including gun charges and child endangerment.

Davis was also hit with an accessory after the fact crime for allegedly trying to throw the gun in the trash after the shooting.

Around 4:30 pm on December 30, deputies responded to a call that a boy had been shot at an apartment complex in the Foothill Farms neighborhood. Upon arrival, they found an unresponsive teenager in the middle of the parking lot “bleeding from his head and neck.”

Deputies attempted CPR until the Sacramento Metro Fire Department arrived and took the boy to a nearby hospital, where he was pronounced dead. The sheriff’s department later confirmed the victim was only 10 years old.

Witnesses at the scene reported the shooter had fled to a nearby apartment. Deputies visited the apartment and arrested Davis and two teenagers without incident.

As homicide detectives and crime scene investigators interviewed witnesses and combed the scene for evidence, they learned one of the arrested teenagers, Davis’ 10-year-old son, had taken his father’s gun when he got out to get him a pack of cigarettes from the car.

The sheriff’s department said the boy “bragged” to the victim that his father had a gun before shooting him once and running into the apartment.

Detectives later found the gun, which police said was stolen in 2017, in a nearby trash can, which they believe Davis was trying to hide.

According to public records reviewed by The Post, Davis has a lengthy criminal history of theft, fraud and felony drug charges dating back to 2011, with convictions in California and Texas.

Due to his prior felony conviction, Davis is legally prohibited from owning or possessing a firearm.

Shortly after the shooting, family members identified the dead boy as Keith Frierson, better known as KJ, to KCRA.

KJ’s aunt, Erika, spoke fondly of her nephew as she placed flowers, balloons and candles around the parking lot in a makeshift memorial for the slain child on Sunday.

“He is smart, very smart, kind, loving, respectful,” he told the outlet. “He didn’t deserve this. He still has a lifetime to live.”

He said KJ had just gone out to ride his bike when the tragic shooting happened.

“He didn’t get outside 15 minutes, and that little boy shot my nephew,” he said.

The alleged child gunman was arrested and taken to the Sacramento County Youth Detention Facility, where he was charged with murder. A spokeswoman for the sheriff’s department said if the criminal case were to proceed, the child could “theoretically” remain in jail until he turns 25 if convicted.

Davis was also arrested and charged with felonies including carrying a stolen firearm in a vehicle, possession of a firearm by a felon, possession of a firearm in the first degree, accessory after the fact and endangering the life or health of a child.

The sheriff’s department told The Post that while his fate is now in the hands of the court, Davis “could see some very serious time based on his charges.”

He is being held on $500,000 bail and is scheduled to appear in court Jan. 3.
