A Southern California school district has agreed to pay $27 million to settle a lawsuit by the family of an eighth-grade boy who died after being attacked by two other students at a middle school four years ago.
A settlement with the Moreno Valley Unified School District was announced Wednesday by attorneys for relatives of 13-year-old Diego Stolz, who was punched at Landmark Middle School in September 2019.
One of the teenagers hit the teenager on the head from behind and he fell, hitting his head on a post.
The teenager then proceeded to punch Stolz, who died nine days later from brain injuries.
The attack was caught on video.
Dave Ring, an attorney for the Stolz family, said the boy’s death could have been prevented if there had been an anti-bullying policy at the school about 65 miles east of Los Angeles.
“Schools need to realize that bullying cannot be tolerated and any complaints of bullying and assault must be taken seriously,” said Ring in a news release.
School officials would not comment on the settlement, district spokeswoman Anahi Velasco said in an email Wednesday.

The district said previously that it was changing its bullying reporting system and training for employees.
In addition, the principal and vice principal of the school have been replaced.
The family’s wrongful-death lawsuit alleges that Stolz complained to an assistant principal that he was being bullied before the attack that killed him.
The attacker, who was 14 at the time of the attack, pleaded guilty in juvenile court to the equivalent of involuntary manslaughter and aggravated assault likely to cause great bodily harm.

The teenager spent 47 days in juvenile detention.
A judge declined to impose more prison terms, but ordered them to undergo anger management therapy.
