Willis’ office has until Friday to file papers opposing Donald Trump’s co-defendant Mike Roman’s attempt to have criminal charges against him dropped on conflict-of-interest grounds based on Willis’ alleged affair with special prosecutor Nathan Wade.
Roman’s lawyers allege that Willis paid Wade an unusually high salary to lead the case against Trump — and his 14 co-defendants — despite Wade’s lack of prosecutorial experience and that he then benefited from her salary when he treated her on vacation. Other defendants including the former president have joined Rome’s motion.
Willis has personally helped to draft his office’s written response to the motion and he may not address the alleged affair — but instead will focus on the legal problems with the argument, CNN reported, citing sources.

Fulton County Superior Court Judge Scott McAfee has scheduled a Feb. 15 court hearing for the two sides to debate the issue, and Roman’s attorneys have subpoenaed Wade and Willis to answer questions under oath during the proceedings — though both may try to get out in person. open to testify.
Wade’s divorce case was also dragged into the public eye after his estranged wife, Joycelyn Wade, questioned Willis and argued that Wade spent money on what he said was a fire while he gave his ex a small amount each month.
A trial in the case was set for Wednesday, but the Wades reached an interim settlement in the 25th hour on Tuesday, canceling the hearing – where Nathan may have been asked questions about the affair.
So far, Willis has not addressed the alleged affair but has suggested the investigation into him is racially motivated.
