Actor Jonathan Majors’ alleged assault on his ex-girlfriend lacks “prosecution merit” — and the Manhattan District Attorney’s Office will not pursue charges against him, a spokesman said Thursday.
Grace Jabbari, 30, turned herself into the NYPD late Wednesday and was charged by police with assault and criminal mischief after the Marvel star filed a counter-complaint against her in connection with a March incident in which she claimed he cheated on her.
Jabbari was given a desk appearance ticket requiring him to report to court at a later date, according to police — but prosecutors said Thursday they would not pursue those charges.
“The Manhattan District Attorney’s Office has officially declined to prosecute the case against Grace Jabbari because it lacks prosecution merit. The matter is now closed and sealed,” a representative said.
Majors, 33, had alleged in a June 22 complaint that Jabbari, a 30-year-old professional dancer, drunkenly scratched and hit her during an argument in Chelsea.
The actor was arrested on March 25 at an apartment near West 22nd Street and Eight Avenue and faces misdemeanor charges of assault and harassment in connection with the altercation.

He has pleaded not guilty and is set to go on trial on November 29 in Manhattan Criminal Court.
A judge set a trial date for Wednesday after rejecting a bid from Majors’ attorney to have the charges thrown out, and after months of delays in the case.
Prosecutors, in court papers this month, said the fight began after Jabbari saw a text on Majors’ phone that said, “I wish I was kissing you right now,” according to prosecutors.

When Jabbari tried to grab the phone from the “Creed III” star, he allegedly handled it – prying his right middle finger from the phone, which caused a bruise, and then twisting his forearm, prosecutors said.
Legal papers state that the DA’s Office will not pursue any case against Jabbari if he is arrested.
He turned himself into the NYPD’s 10th precinct on Wednesday night.

His lawyer, Ross Kramer, said outside the police station that prosecutors determined that Jabbari was not the aggressor in the incident.
“He’s the victim in this case and, you know, they’re going to do the right thing,” Kramer said Wednesday. “It happened that we had to come in here. And ask him to shop and, you know, unfortunately, a bad night at the police precinct.”
