Delta pilot sues after moving sidewalk at Denver airport ‘swallowed’ his foot, caused fall

A Delta pilot has filed a lawsuit after his foot got caught on a moving sidewalk at Denver International Airport, causing him to fall and suffer injuries.

Kenneth Gow, a pilot who lives in Utah, sued TK Elevator Corporation in December and claimed that a missing piece at the end of the walkway caused the trip, according to the lawsuit.

As a result of the fall, which occurred in November 2022, he suffered leg and shoulder injuries that required physical therapy and kept him out of work, KUSA reported.

A video of the incident obtained by the outlet shows Gow walking down the exit door moving with his bag. When he got to the end, his foot got stuck in a missing piece of comb plate and he fell to the ground, the video shows.

A good Samaritan behind him helped him free his leg from the machine as travelers watched. He got back up and could later be seen explaining what happened to airport staff, according to the clip.

“It is very fortunate that Mr. Gow was not more seriously injured,” Gow’s attorney, Brian Aleinikoff, told KUSA.

The lawsuit, obtained by Law&Crime, states that the pilot was approaching the sidewalk on November 4, 2022 when he “suddenly felt a surge of pain in his leg and collapsed.”

When he looked back, Gow “saw that his foot and shoe had been swallowed up by the sidewalk because it was missing a plate,” the lawsuit alleges. “Ken’s legs, socks and shoes were badly damaged.”

“Fortunately, Mr. Gow wears rather large shoes. It was fortunate that he didn’t lose his toes,” Aleinikoff said.

Pictures show Gow’s shoes and socks appear to have been completely chewed up after the incident, with holes in the heels.

The broken track “poses an unreasonable risk of injury to passengers on it,” creating dangerous conditions, Gow claimed.

He went to a clinic in his home state of Utah three days after the fall with injuries to his left ankle, left foot and left shoulder.

He has undergone physical therapy but is still in serious pain, according to the lawsuit.

Doctors told Gow to wear a leg brace and he was diagnosed with a strained left Achilles tendon and bruised left leg, according to court documents.

Gow is seeking an amount to be determined at trial for his medical expenses as well as damages for physical suffering, emotional distress and mental anguish.

Denver International Airport told KUSA in a statement that “The safety of our passengers and employees is always our top priority and we are working diligently every day with our contractors to address the issues.”
