Ed Sheeran Wins Second Lawsuit Over ‘Thinking Out Loud’ And Marvin Gaye’s ‘Let’s Get It On’

Ed Sheeran has emerged victorious from a second copyright claim without facing any jury.

The dismissed case was brought by Structured Asset Sales LLC, which accused the singer of lifting elements from Marvin Gaye’s “Let’s Get It On” to create his hit single “Thinking Out Loud.”

Earlier that month, Sheeran won a similar copyright suit filed against him by Gaye’s co-songwriter’s family. He also recently credited rapper Eminem for helping him overcome his speech impediment.

Per people magazine, Sheeran’s second copyright claim will not get its day in front of a jury, which was dismissed by US District Judge Louis Stanton of Manhattan federal court on Tuesday.

The case was filed by Structured Asset Sales LLC, claiming that Sheeran’s “Thinking Out Loud” and Marvin Gaye’s “Let’s Get It On” have similarities that seem to imply that the British pop singer is ripping off the classic.

The plaintiff owns a third of the shares of Gaye’s “Let’s Get It On” purchased from the family of co-writer Ed Townsend in 2018.

However, in a surprising turn of events, Stanton dismissed the copyright case, ruling that the elements claimed by the plaintiffs as plagiarism could not be protected under copyright law because they were too common.

The decision follows Sheeran’s court victory earlier this month over another claim of copyright infringement on Gaye’s 1973 song.

A previous copyright case, which Stanton also presided over, is said to have hurt Sheeran’s feelings.

The singer allegedly missed his grandmother’s funeral because of the trial and admitted to the press after the verdict that the ordeal had left him “disappointed” even though the verdict was in his favour.

He also shared his gratitude for not having to “quit his day job,” referencing his pledge during the trial to quit music if jurors chose against him.

The singer stated that “baseless allegations” that give rise to copyright claims should not be “allowed to be brought to court,” adding that it could set a precedent that would restrict the “creative freedom of songwriters.”

Throughout the trial, several pieces of evidence were presented by both Sheeran’s attorneys and the plaintiff to influence the jury’s verdict, per Diversity.

Court attendees also saw Sheeran play guitar during one of the court sessions to demonstrate his musical process for creating songs.

When it came time for the jury’s final deliberations, Judge Stanton advised them to make a decision based on the facts by “a preponderance of the evidence… that Sheeran actually copied and miscopied ‘Let’s Get It On.'”

In the end, the ruling was in Sheeran’s favor, saving him from having to pay up to $100 million to the Townsend family. He previously won a UK copyright battle claiming he ripped off elements of Sami Chokri’s “Oh Why” for his hit song “Shape of You.”

Away from his recent legal troubles, Sheeran revealed that famous rap icon Eminem helped him overcome his childhood stutter.

He made the revelation during an appearance on “The Howard Stern Show,” saying that listening to and rapping Eminem’s “The Marshall Mathers LP” helped with his speech problems.

“By learning the record and playing it back to back, it cured my stuttering,” Sheeran said of the music project, per Insider.

The duo have since collaborated on multiple songs, including the 2017 chart-topper “River.” Although the two have different musical styles, Sheeran admits to having developed a relationship with the rap icon.

“I’ve known him now for six years, and we’ve sung three songs together; I have played with him twice on stage. He’s another person I relate to, because he still lives in his hometown and has an ecosystem around him,” Sheeran said elsewhere in his interview.
