The new hurdle comes less than three months after The Blast reported that he was considered a flight risk after he booked a one-way trip to Mexico. The CEO involved has been hit with a lawsuit seeking to move the date his prison sentence will begin closer to the April date.

The suit, which also accused the mother of two of living in luxury, was countered by her lawyer, who insisted she had bought the plane tickets long before she was found guilty.

In fact, it was confirmed that Holmes planned to go to the Spanish region to participate in his friend’s wedding. In an attempt to refute the prosecution’s claims, a member of his legal team wrote:

“Given that decision, he did not intend to make the trip and therefore did not give notice, obtain permission, or request access to his passport (which the government has) for the trip.”

In case you missed it, Holmes’ downfall and legal troubles began shortly after several journalistic and regulatory investigations uncovered a pattern of untruths about Theranos’ technology claims in 2015.

A Wall Street Journal investigation revealed at the time that the company had misled investors with its claims that it had developed technology that would allow a few drops of blood to be used to test for various conditions. Holmes was later indicted in 2018.

Holmes Requests A Later Date For His Trial To Begin

Last November, The Blast stated that the blonde beauty was pregnant with her second child during her trial, which begins in mid-2021. As such, her legal team asked the court to delay the start of her prison sentence to focus on bonding with the child.

The pregnancy was separated from the child the 39-year-old welcomed with partner Billy Evans shortly before his trial began. The couple notified the court of the pregnancy in March 2022 after her attorney, and prosecutors filed court documents.

The paper, which pleads that the trial should start later than the scheduled date in July, reads, “The parties have met and consulted, and both sides agree that, based on these developments, it is not possible to start the trial on July 13 , 2021, as currently scheduled.”

It also detailed, “Based on the Defendant’s pregnancy, the parties stipulate and agree, and respectfully request that the Court order that the trial commence with jury selection on August 31, 2021.”

According to birth records, the couple welcomed their baby, a son named William Holmes Evans, in Redwood City, California, on July 10.
