This legal dispute stems from a tragic incident that occurred in March when Dillard, Adams’ 6-year-old son, fell from the fifth floor window of his New Jersey apartment. The fall resulted in serious injuries, resulting in Zohar being hospitalized in the ICU.
Amazingly, he survived the 50-foot plunge, although he had to endure wearing a full-body cast and relearn how to walk.
In response to the fatal fall, Adams filed suit against several parties, including a construction company and a window installation company, holding them accountable for the incident. She claimed that the “improperly sized guard” on the window contributed to her son’s fall.
In her legal documents, Adams also revealed that the fall had caused permanent injuries, leaving her son unable to “perform his normal functions.”
In the initial civil suit, Adams, acting as guardian to her son Zohar, is seeking a trial by jury, punitive damages and coverage for her son’s substantial medical expenses. He detailed his extensive injuries, including broken bones in his pelvis and left leg, a lacerated liver, a collapsed lung and internal bleeding.
‘My Heart Is Broken Into A Million Pieces’
In an emotional statement to News 12 New Jersey at the time, Adams expressed her grief, describing her situation as a single mother of a child with special needs as a “nightmare”.
“My heart broke into a million pieces,” he said.
Adams added: “I am devastated, angry, and struggling to come to terms with the fact that my only child has been seriously injured as a result of the willful negligence of our landlord and others involved in failing to take necessary safety precautions.”
After the shocking incident, residents of the Adams apartment building expressed disbelief at Zohar’s survival after falling from the fifth floor.
James Lucas, a neighbor who lives on the sixth floor of the building, spoke to him Daily Mail and recounted seeing the child’s “lifeless” body sprawled on the concrete below. He admitted, “He was just on the ground, not moving, I thought he was not going to live.”
Lucas, who shares a similar apartment layout to Adams, raised concerns about the building’s windows, noting a child could “definitely stand on” the threshold.
Remembering the situation, he said, “You can certainly, if you are a child, stand on that threshold, but my children have never been here. I think they should look into window guards for sure.”
