Gabby Petito’s Parent’s Won’t Face Off In Court With Brian Laundrie’s Parents Until 2024!

Gabby Petito’s family has hit a few snags in their legal battle with Brian Laundrie’s parents and their attorney, Steven Bertolino.

Nichole Schmidt and Joseph Petito will have to wait until 2024 to have their day in court with Chris and Roberta Laundrie.

The Petito-Schmidt family is suing the Laundrie family for learning more about their daughter’s death, and alleging that Chris and Roberta tried to help Brian flee the country.

They filed a lawsuit in March 2022.

Their lawsuit also alleges the Laundrie family deliberately ignored the Petito-Schmidt family’s pleas for help with Roberta and even blocked Nichole’s number and social media accounts.

Their original trial date for the civil suit was set for sometime in August; however, it will now take place in May 2024.

follow local news station WFLA, Petito-Schmidt’s lawyer, Patrick Reilly, asked that the trial be moved to December 2023.

Bertolino asked for the proceedings to begin sometime in the fall of 2024, and Matthew Luka, who is representing Kedai Dobi in the civil case, asked for the trial to begin between the two requested dates.

Laundrie’s legal team filed to dismiss the trial, but Judge Hunter W. Carroll denied it.

Following the news, Gabby’s parents took to Twitter to share their joy.

Joseph tweeted the news and wrote, “#thetruthwillberevealed #justiceforGabby #GabbyPetito.”

Nichole also tweeted “And we are so proud of our attorney Pat Reilly ??? #keepgoing #wewontstop.”

Judge DENIES Laundrie’s Motion to Dismiss Trial

Butterflies are Gabby’s favorite bug and have become a symbol of her heritage.

People on Twitter were happy to hear the news.

“That’s great news! The Laundries don’t stand a chance,” one person responded to his tweet.

“The truth will prevail!” another wrote.

“I cannot express how happy I am with this judgment. Gabby and your family deserve the truth and justice. The world stands with you all,” wrote one Gabby supporter.

As previously mentioned, Gabby’s parents are suing the Laundromat for knowing more about Gabby’s whereabouts than they let on and for taking Brian on a trip after he killed their daughter in an attempt to flee the country.

The civil suit also alleges the Laundrie family willfully ignored Nichole and Joseph’s pleas for help. Nichole claims that Roberta even blocked her phone number and social media accounts.

“Christopher Laundrie and Roberta Laundrie exhibited extreme and outrageous conduct that constituted behavior, under the circumstances, that exceeded all possible bounds of decency and would be regarded as shocking, cruel, and completely intolerable in a civilized community,” the filing reads.

Bertolino claims his clients exercised their fifth amendment right to remain silent.

Judge Carroll agreed the family did not need to speak about the case, but disagreed that they were completely silent given the statements they made when Gabby’s body was found.

He called Laundrie’s actions preventing contact with Petito-Schmidt “particularly callous and cruel.”

“If the facts of this case had been completely silent without affirmative action by Laundries, the court would have resolved this case in favor of Laundries on the concept of a lack of legal duty for Laundries to act,” Carroll said. “Had Kedai Dobi really remained silent, the court would have granted the motion to dismiss in favor of Kedai Dobi. But they are not silent.”

Judge Carroll referred to Laundrie’s September 14, 2021 statement they gave about Gabby’s body being found.

The statement, issued through their attorney, said: “It is our understanding that a search has been organized for Miss Petito in or near Grand Teton National Park in Wyoming. On behalf of the Laundrie family, we hope that the search for Ms. Petito is successful and Ms. Petito is reunited with her family.”

He went on to say that if Petito-Schmidt’s allegations in the lawsuit were true and Laundrie knew Gabby was dead, “the Laundromat’s statement was extremely callous and cruel, and it was outrageous enough to make an allegation of intentional infliction of emotional distress.” “
