Republican presidential hopeful Nikki Haley is demanding that President Biden “immediately” undergo a mental competency test following a special counsel’s report denouncing his age and poor memory — as at least one congressman is seeking to force him from office.
“Joe Biden can’t remember big events in his life, like when he was vice president or when his son died,” Haley aired on X Thursday night, following a report in which special counsel Robert Hur described the president as “a demented old man.”
“That’s sad, but it’s going to be even sadder if we have someone in the White House who doesn’t have the mentality for the most important job in the world.
“Joe Biden should take a mental competency test immediately, and it should be shared with the public.”
In a more than 300-page report released Thursday, Hur concluded that even if the 81-year-old president “willfully retained and disclosed classified material,” Hur would not recommend charges, noting “it would be difficult to convince a jury that they should convict him” of a crime weight that “requires a deliberate mental state.”

Based on the report, Rep. Claudia Tenney (R-NY) sent a letter to Attorney General Merrick Garland, calling on the cabinet to “explore” the use of the 25th Amendment to remove Biden from office.
He wrote that he had “grave concerns” about the president’s mental acuity, according to Fox News, which first obtained the letter.

“Having concluded that President Biden knowingly and willfully removed, misappropriated and disclosed classified documents repeatedly over a period of decades, Mr. Hur nevertheless recommended that charges not be brought against him,” wrote Tenney, who represents part of upstate New York.

“He recited numerous incidents in which President Biden exhibited dramatically impaired mental abilities and concluded that a jury would likely perceive President Biden as a sympathetic, forgetful old man.”
Tenney went on to tell the attorney general that he “doesn’t need to tell you that selective prosecution is morally, ethically and legally prohibited.
“We do not prosecute or refuse to prosecute people based on their personality or based on the public’s perception of them,” he said.
“If the Special Counsel finds that the evidence forms a reasonable basis for bringing charges, he must do so.”
Haley posted on X Thursday night that it would be sad “if we have someone in the White House who is not fulfilling the most important job in the world.”
Tenney also said the Justice Department “cannot ethically bring charges against the former President.” [Donald] Trump because he has mental acuity and a strong personality, and refuses to impeach President Biden because of his cognitive impairment.”
He said Biden “should be impeached unless he is mentally incompetent to stand trial.”

“Not being able to remember what position he held and when is very worrying. Not being able to remember when someone’s child died — even within a few years — may be a worse reflection of their mental disability.”
Tenney added that Biden “appears to lack the ability to carry out his presidential responsibilities.

- Special counsel Robert Hur ruled that President Biden “willfully retained and disclosed classified material” after leaving office as vice president in 2016.
- Records kept by Biden include documents on military and foreign policy in Afghanistan as well as other national security and foreign policy issues.
- Biden kept some classified documents to help write his memoirs. According to the report, Biden told a ghostwriter in a 2017 conversation that he “just found all the classified stuff downstairs.”
- Despite those findings, Hur’s 388-page report recommended that the president not face charges.
- The special counsel noted that Biden would likely present himself to jurors as a “sympathetic, well-intentioned old man with a failing memory” if he stood trial.
“So it is your responsibility to explore the proceedings to impeach the President according to the 25th Amendment of the United States Constitution,” he argued.
“President Biden needs to be impeached, or he needs to be removed,” he said.
“There is no middle ground.”
