On April 21, special prosecutors Kari Morrissey and Jason Lewis officially dismissed the criminal charges facing Alec Baldwin for the October 2021 shooting of “Rust” cinematographer Halyna Hutchins.
Baldwin faces two counts of involuntary manslaughter. These are the same charges facing “Rust” shield Hannah Gutierrez-Reed, although her initial hearing has been postponed until August.
Although the charges were dropped, the special prosecutor explained that they are dismissing the charges without prejudice, and may refile criminal charges as they continue their investigation.
Alec Baldwin Could Face Criminal Charges Again In The Future

Just a day before they officially filed to dismiss the charges in First Judicial District Court in Santa Fe county, special prosecutors Kari Morrissey and Jason Lewis released a statement explaining exactly why they plan to drop the charges.
“Over the past several days and in preparation for a preliminary hearing on May 3, 2023, new facts have come to light that demand further investigation and forensic analysis in the case against Alexander ‘Alec’ Rae Baldwin, III,” they began.

“Therefore, we cannot proceed under the current time constraints and based on the facts and evidence submitted by law enforcement in their current form,” they continued. “Therefore we will dismiss the charge of involuntary manslaughter against Mr. Baldwin pending further investigation.”
“This decision does not absolve Mr. Baldwin of criminal wrongdoing and charges may be refiled,” they warned. “Our follow-up investigation will remain active and ongoing.”
Halyna Hutchins’ Parents, Sister ‘Remain Hopeful’ That Alec Baldwin Will Still Face Criminal Charges For Shooting ‘Rust’

In February 2023, Hutchins’ mother, Olga Solovey, her father Anatolii Androsovych, and sister Svetlana Zemko, filed a lawsuit against Alec Baldwin, the producer of “Rust”, and a handful of other companies and individuals alleging negligence that resulted in Halyna’s death.
After the charges were dropped, attorney Gloria Allred, who is representing the family, said her client “remains hopeful” that Baldwin will face justice, despite the current decision to drop charges against the actor in a new statement provided to Deadline.

“Mr. Baldwin could pretend that he wasn’t responsible for pulling the trigger and firing the live bullet that ended Halyna’s life,” he said in a statement. “He could have run off to Montana and pretended that he was just an actor in a wild west movie but , in real life, he can’t escape the fact that he has a major role in a tragedy that has real-life consequences.”
It’s worth noting that Gloria Allred also represented “Rust” script supervisor Mamie Mitchell in a lawsuit she filed against Baldwin and other “Rust” producers in November 2021.
Alec Baldwin Tried To Get Out Of Hutchins Lawsuit

In April, Baldwin’s legal team tried to argue that he should not be named in a new lawsuit filed by Halyna Hutchins’ parents and younger sister. While admitting that “losing a daughter and sister is certainly painful under any circumstances,” Baldwin’s legal team claimed that the Hutchins family had been “estranged from Halyna physically, financially and emotionally for years before her death” and ” not viable.” cause of action against the Defendant.”
Baldwin’s legal team went on to call the new lawsuit “misguided,” adding, “Even if New Mexico law were to apply, Plaintiff’s cause of action would still fail, as Plaintiff’s complaint provides nothing more than a conclusory statement, that , no matter how often it is repeated cannot support a sufficiently close relationship under the law, as required by New Mexico law to state a loss of consortium claim.”
Matthew Hutchins Settles Lawsuit With ‘Rust’ Producer

In February 2022, a few months after Halyna’s death, her husband, Matthew Hutchins, filed a wrongful death lawsuit against Alec Baldwin and other “Rust” producers. The lawsuit was settled in October 2022. As part of the settlement, Matthew will serve as an executive producer for the film.
In a statement at the time, Matthew Hutchins said, “We have reached a settlement, subject to court approval, of our wrongful death lawsuit against the producers of Rust, including Alec Baldwin and Rust Movie Productions, LLC. As part of that settlement, our will be rejected.”

“I’m not interested in getting involved in accusations or accusations of blame (on the publisher or Mr. Baldwin),” Hutchins added. “We all believe that Halyna’s death was a terrible accident. I am grateful that producers and the entertainment community have come together to pay tribute to Halyna’s final work.”
He is said to have given his “blessing and support” to new cinematographer Bianca Cline, who has worked on the critically acclaimed “Marcel the Shell With Shoes On.” According to Rust Movie Productions, Cline will donate his salary to charity.

Director Joel Souza has said that the decision to end the film with Matthew Hutchins was “bittersweet” but will end the film “on Halyna’s behalf.”
He echoed comments from “Rust” producers that no “working firearms” or ammunition would be allowed on set for the Western, which is expected to wrap in May.
