Hunter Biden was loaded in more ways than one in October 2018, federal prosecutors charged Tuesday in a scathing response to the first son’s attempt to dismiss the weapons charges against him.
Five years after the man’s now 53-year-old brother-in-law turned lover Hallie Biden tossed Hunter’s firearm into a trash can behind a Delaware grocery store, FBI officials are re-examining the gun.
Agents removed a sealed Colt Cobra 38SPL revolver from a state police vault to photograph the weapon last year and found white powder on the pouch that housed the weapon, court filings from special counsel David Weiss revealed.
“An FBI chemist later analyzed the residue and determined that it was cocaine,” the 52-page document read.
“To be clear,” the prosecution’s motion added, “investigators did find drugs on the pouch where the defendant kept his gun.”

Weiss’ team responded to a motion to dismiss the gun charges filed by Hunter Biden’s attorney last month.
In the rebuttal, Weiss’ team recounted the evidence they had to confirm that the troubled first child was using illegal drugs at the time he completed a background check to buy the gun and said he was not addicted to any illegal substances, committing a federal crime. in progress.
At another point in the rebuttal, prosecutors referenced Hunter Biden’s 2021 memoir “Beautiful Things” in which he “made countless statements about drug use over the years.”
“The defendant’s choice to sell a book containing these confessions not only makes the government’s case against him stronger but also increases the potential general deterrence value of the prosecution,” Weiss’ team wrote.

Prosecutors stated that Hunter Biden continued to write the book after he was informed that local authorities had recovered the gun from an elderly man who was sorting recyclables from the trash and that there was an ongoing federal investigation into the matter.
They also pointed to messages, including one Hunter exchanged with Hallie, who had disposed of the gun about 11 days after he bought it.
Hunter Biden’s legal team, led by attorney Abbe Lowell, has alleged that Weiss succumbed to “political pressure” by bringing the gun charges in Delaware.
Last July, Hunter Biden was set to enter a jail-free plea deal to two misdemeanor counts of willful failure to pay taxes and enter a diversion program for a felony federal firearms charge.

But the deal imploded during a dramatic courtroom hearing when it became clear to the eldest son’s attorney that the agreement was not intended to provide blanket immunity from prosecution for other offenses.
A month later, Weiss, Delaware’s US Attorney, was granted special counsel status by Attorney General Merrick Garland.
Hunter now faces three federal firearms-related felony charges for the ordeal.
Additionally, he has three felony and six misdemeanor charges pending against him in Los Angeles for allegedly evading $1.4 million in taxes between 2016 and 2019.
“Based on the facts and the law, if Hunter’s last name was anything other than Biden, charges in Delaware, and now California, would not have been brought,” Lowell said last month.

Prosecutors blasted the defense attorney’s claims on Tuesday.
“Contrary to his assertion, he did not establish that the Special Counsel, appointed by and serving at the pleasure of President Biden and his Attorney General, punished the defendant ‘for the perceived sin of his father’ in surrendering to the former President for his tweets,” Weiss’ team said.
“This theory is a fiction designed for a Hollywood script.”

Hunter Biden has used his drug addiction and recovery efforts — he now claims to have achieved sobriety — as shields against congressional and legal scrutiny.
“My struggles and my mistakes have been fodder for a vile and ongoing disinformation campaign against him [President Biden]and the complete obliteration of my reputation through high-profile but fruitless congressional investigations and, more recently, criminal charges for possessing an unloaded firearm for 11 days five years ago – charges that appear to be the first of their kind ever brought. in Delaware history,” he wrote in a USA Today op-ed last year.
The Lowell firm did not immediately respond to a request for comment.
Last month, Hunter Biden refused to testify before a GOP-led House impeachment inquiry that defied subpoenas after demanding a public appearance, which Republicans refused.
He is now reportedly in negotiations to appear before the House Oversight and Judiciary committee.
