Hunter Biden’s lawsuit alleging former NYC Mayor Rudy Giuliani hacked and manipulated data on his famous laptop — allegedly destroying the first child’s “digital privacy” — should be thrown out, a new filing claims.

The first son filed a lawsuit in September against Giuliani, his company and his former attorney Robert Costello, accusing them in Los Angeles of violating federal law when they accessed the laptop’s hard drive and turned over its bombshell contents to The Post in October 2020.

Alan Gordee — an attorney for Costello and Giuliani’s company — argued in Thursday’s filing that Hunter’s suit raises a “really weird theory” that the laptop was not his, but was “a laptop masquerading as a Biden laptop containing malicious files that has been falsely attributed to him mixed with files purportedly stolen or hacked from him.”

“Biden carefully coordinated between” having some “hacked” laptop data, while claiming “the worst” material on the computer was planted, Gordee said.

While Biden’s allegations are “absurd,” Gordee argued, the suit should be thrown out on jurisdictional grounds since Giuliani, Costello and the allegations against them have nothing to do with the Golden State.

“All statements made by defendants regarding Hunter Biden, the Biden Laptop, or in any other way related to or regarding the allegations in the Complaint occurred in the State of New York,” the filing alleges.

Biden’s case also contains “many glaring omissions” — including failing to say when the alleged hacking took place and whether or not the information from the laptop belonged to him, court documents allege.

There are also issues with the statute of limitations, as the younger Biden waited until last year to sue even though he was supposed to do so in 2021, the filing claims.

Lawsuits against Giuliani have been on hold since the former “America’s Mayor” filed for bankruptcy last month.

Hunter Biden, 53, has also sued computer repair shop owner John Paul Mac Isaac in Delaware for allegedly disseminating and “weaponizing” the contents of the laptop.

Biden has asked Mac Isaac, Giuliani and former Trump White House strategist Steve Bannon to face criminal charges for their involvement in leaking the laptop information — which has been confirmed by the FBI, Justice Department and IRS.

Attorney Mac Isaac has claimed that his client became the rightful owner of the computer after Biden dropped it off in April 2019 and then did not return to retrieve it — instead signing documentation acknowledging that the change in ownership would take effect in that instance.

Biden’s laptop has scandalous photos of the first son doing drugs and partying with prostitutes.

Mac Isaac told the FBI about the laptop after accessing its hard drive and seeing emails, bank statements and other financial information related to an alleged influence peddling scheme involving Joe Biden, the current president – as well as photos of the eldest son using drugs. and make friends with sex workers.

The store owner made a copy of the hard drive and gave it to Costello in August 2020, after turning over the original to the feds in December 2019.

Biden and Giuliani are both facing numerous separate legal issues.

In August, Giuliani was indicted along with former President Donald Trump and 17 others in Georgia for allegedly trying to overturn the results of the 2020 election there.

The following month, Costello sued Giuliani, claiming the former mayor owed more than $1 million in legal fees.

Meanwhile, Hunter Biden faces three gun-related felony charges in Delaware, as well as tax charges in Los Angeles.

Attorneys for both sides did not immediately return requests for comment Thursday.
