She is suing Foxx for damages, alleging “sexual assault, abuse, assault and battery.” The lawsuit states that the actor appeared drunk as he agreed to take a photo with the unnamed woman, saying, “Sure, honey, anything for you.”

A representative for the actor released a statement to People magazinevehemently denied the accusations and revealed Foxx’s plans to counter-sued him for “malicious allegations.”

“The alleged incident never occurred,” the statement began. “In 2020, this individual filed an almost identical lawsuit in Brooklyn. The case was dismissed shortly thereafter. That claim is no more viable today than it was then. We are sure they will be fired again.”

The spokesperson continued, “And once they do, Mr. Foxx intends to pursue a claim for malicious prosecution against this person and his attorney for refiling this frivolous action.”
