A “premeditated” vacation with his daughter and two sons prevented Costner from appearing in court on Wednesday, July 12, court documents reviewed by PEOPLE have demanded As it turns out, the “Yellowstone” actor had scheduled a trip to British Columbia, Canada, with the teenager months before the recently postponed court date.
Regarding the screen star and Baumgartner’s joint custody of the teenager and why they spend time with their famous father unsupervised, the former’s legal team stated in the paper:
“The child is still a teenager and will probably come and go between her home and Christine’s home once she finds a new home.”
The update comes days after it was revealed that a judge had provisionally approved Baumgartner’s request to receive $129,755 per month in child support.
Although her ex-husband is also mandated to pay $100,000 in forensic costs and $200,000 in attorney fees, both parties must shell out 50% for their children’s health care, sports and extracurricular activities expenses.
The legal document regarding the ruling further states that these payments shall be made on the “first day of each month” with “credit for amounts paid between July 1 and July 12.” Baumgartner initially asked to be paid $248,000 per month in child support or “alternatively, at the guideline rate of $217,300 per month, paid on the first day of each month.”
The bag designer also wanted Costner to cover the entire cost of their children’s sports, extracurricular activities, health care expenses and private school tuition, which the “Yellowstone” star quickly denied.
In his filing, he has declared that his ex-wife’s $248,000 child support request includes more than $100,000 that the German-American plans to use for her cosmetic surgery fees. The father of seven also wrote in the document that the $51,940 he pays each month is reasonable enough for child support.

Before Costner went on his solo trip with his kids, Baumgartner went on a solo vacation earlier this month. According to The Blast, the Cat Bag Couture creator was spotted with her luggage and a cup of coffee as she arrived at LAX airport, ready to take a break from the dramatic divorce proceedings.
The timing couldn’t be better as she is scheduled to appear in court this week to contest the terms of her prenuptial agreement with the “Let Me Be The One” singer. It also comes after she expressed her displeasure about how the actor broke the news of their breakup to their children.
In case you missed it, the “How Deep the Water Runs” musician peppered Grace, Cayden, and Hayes with information during a ten-minute Zoom call he made from the movie set in Las Vegas. Not only did this mean that Costner had deviated from Baumgartner’s original plan to tell the three of them together and in private, but it also frustrated and disappointed him.
In legal documents he filed, the 49-year-old addressed the incident, stressing that he had expressed his concerns about the children finding out about the divorce from outsiders to the film producer. He claimed to have included several articles that emphasized the importance of presenting a united front when discussing such sensitive matters with their children.
Unfortunately, Costner didn’t share his sentiments of making the best of the situation and putting his concerns aside. Baumgartner later asserted that the “Robin Hood: Prince of Thieves” actor “insisted that he had the right to tell them we were going to divorce ‘first’ and tell them in private” without his permission, knowledge or presence.
“The welfare of the children is always my priority, and I am worried that they will find out about the divorce before Kevin and I can tell them. It is important for me to tell the children personally and together,” he explained in the paper.
