According to court documents obtained by The Blast, model Jourdan Whitehead is suing Good American for late payment penalties after not paying her on time for services performed within one day. The document, filed in Los Angeles County on Wednesday, February 15, states that Whitehead is “a professional actor who earns his living by working as an actor in the production or broadcast of films.”

According to the California Labor Code, “film production or broadcast” means “the development, creation, performance, or broadcast of a theatrical or television film, television show, commercial advertisement, music video or any other moving image, including, but not limited to, the production made for entertainment, commercial, religious or educational purposes, whether these productions are presented by film, tape, live broadcast, cable, satellite transmission, Webcast or any other technology currently in use or may be adopted in the future.”

In November 2021, Whitehead claimed that he had worked for Good American on November 17, 2021, in the city of Calabasas, California. Whitehead said that she “performed modeling services pursuant to and under the full direction and control” of the company, along with its staff and agents.

The only time Whitehead worked for the company was on that one day. He claims that, according to the initial documents, he should have been paid at the rate of $3,500.00 per day. In other words, since he only worked on one day, he should have been paid for one day of work.

Given Good American’s pay cycle, Whitehead claims he is “entitled” to be paid by Dec. 10, 2021, according to court documents. However, Whitehead claims that he did not receive payment until March 11, 2022, which is several months after he should have been paid.

Whitehead now claims that “their failure to pay on time [her] his wages were deliberate in that regard [Good American] required to make timely payments, was able to do so, but chose not to do so,” thereby qualifying him for a late payment penalty under California Labor Code 203.

According to the legal document, “Labor Code section 203 provides that when the employer fails to make timely payment of wages, the employee’s wages will continue as a penalty until paid or for a period of up to 30 days from the time the wages are due, whichever period is due .”

Since the payment was more than thirty days later, Whitehead claimed he was “entitled to a penalty in the amount of $105,000.00, which [her] daily rate multiplied by 30 days.” He also wants the company to cover his attorney’s fees and additional legal costs.
