Last September, the mother of six asked for her divorce to be set aside because of her ongoing sexual relationship with the former athlete. The legal document states:
“The parties have engaged in marital intercourse several times since the filing of the Petition for Divorce and most recently on or about September 7, 2023.”
Zolciak’s team claims the divorce based on their broken bond is false due to the continued intimacy between the couple. “The allegation of irretrievable marriage is false if both parties have resumed living together or have reconciled for any period,” the petition reads.
“The fact of cohabitation or reconciliation shows that there is still a possibility that the marriage is viable…the parties are required to confirm once again that the marriage cannot be restored by bringing a new complaint,” the entertainer’s document continued, asking the court to allow the second marriage- both continued.
In addition, the legal filing emphasizes the “Dancing with the Stars” alum’s refusal to separate from Biermann because it is “based on the parties’ lack of bona fide separation at the time of the filing and after the filing of the Petition.”
