Kroy Biermann and Kim Zolciak are not on the same page.
Shortly after the “Real Housewives of Atlanta” star shared that she wanted to finalize the divorce, her estranged husband rejected her request.
Kroy Biermann Still Wants Divorce & Wants to Sell Family Home
In court documents obtained exclusively by The Blast, Biermann disagreed with Zolciak’s request to annul their divorce after a second attempt to separate.

“The applicant has no desire to reconcile. The fact that she engaged in sexual relations with the Respondent does not indicate a desire for reconciliation,” the document reads. “The applicant, after this second filing, remains steadfast in his desire to divorce the Respondent, leaving the conjugal residence, even though the house is now in pre-foreclosure.”
Biermann has described Zolciak’s initial petition as a “legal game,” adding that “filing the motion is just another delaying tactic in Respondent [Zolciak]playbook as indicated by his exclamation “I’m staying here going nowhere!”
The former NFL player also wants to continue selling the family home. “The parties are in dire financial straits,” an excerpt from the court document reads. “The only asset they currently have with equity is the matrimonial home. The mortgage is held in the petitioner’s name. However, it is set to be seized in November.”
Biermann claimed that Zolciak had been away from their home for about two weeks filming MTV’s “The Surreal Life.”
Explaining why their Alpharetta mansion is worth selling, the former Atlanta Falcons player argued, “current living conditions are unsustainable and detrimental to the mental and emotional health of minors. If the marital residence is sold, it will provide enough income for both – both parties to get their respective residences, thus taking the children out of the toxic environment.”
In the reality star’s previous petition, she claimed that Biermann’s claim that their marriage was “irretrievably broken” was false because they were still going at it— meaning they were still having sex.

“The allegation of irretrievable marriage is false if the parties have resumed living together or have reconciled for any length of time,” the filing said. “The fact of cohabitation or reconciliation shows that there is still a possibility that the marriage is viable…the parties are required to confirm once again that the marriage cannot be restored by bringing a new complaint.”

Weeks before the estranged couple recently went back and forth in court, the “Don’t Be Tardy” star announced to the world that she and Biermann are doing the best even after she filed for divorce a second time.
The 45-year-old took to Instagram to share a glimpse of her large walk-in closet with Christian Louboutin heels and a few other designer shoes, noting that she’s “staying here, not going anywhere!” and that “daily lies are too many.”
Her rep also confirmed that reports of her moving out of her $3 million Georgia home are “not true.” Zolciak and Biermann’s romance began in 2010 when they met at a charity event. They soon fell in love and tied the knot a year later – a wedding covered on their reality show “Don’t Be Tardy.”
Biermann adopted his estranged wife’s daughters, Brielle and Ariana, from his previous relationship in 2013, and gave them his name. However, things began to fall apart in May 2023 when they first filed for divorce.

They eventually dismissed the divorce action in July 2023, but Biermann soon filed again on August 24, 2023. Sources claim Zolciak’s bad gambling issues meant they couldn’t reconcile. Moreover, they are also unable to overcome their financial crisis.
“They’ve become very petty about who doesn’t pay the bills. They are counting down the seconds to the penny,” the insider claimed. Biermann is seeking primary custody of their four young children and wants Zolciak to pay child support, according to The Blast.
