Legal Expert Talks Alec Baldwin’s Odds After ‘Rust’ Armorer Guilty Verdict

On Wednesday, a jury in New Mexico found “Rust” actress Hannah Gutierrez-Reed guilty of involuntary manslaughter in connection with the fatal shooting of cinematographer Halyna Hutchins.

Although actor Alec Baldwin does not face his own trial until July 9, many are wondering if the fate of the rookie shield might hint at whether a separate jury will find the “30 Rock” actor guilty of his own involuntary manslaughter charges.

Police in the US have released video footage from the set of the film Rust, including the fatal shooting of a cinematographer by actor Alec Baldwin.  Halyna Hutchins, 42, was shot by Mr Baldwin as she trained with what she believed to be a firearm.  The footage, which has no audio, was released showing Baldwin dressed as a cowboy practicing with a gun before the fatal shooting.  He can be seen in stills from the video posing with a gun, and with bullets/bullets on his costume in a scene set in a church.  A clapboard with Ms. Hutchins' name can also be seen.  It is not known if the gun he was holding was the one that fired the fatal bullet.  The actor, who is also the film's producer, previously said he did not draw attention and did not know how live bullets appeared on set near Santa Fe in the US state of New Mexico. Given that it took the jury less than three hours to find Hannah Gutierrez-Reed guilty, Baker felt “that has to be something to point to [Baldwin’s] team that he could also be convicted in this case.” He went on to say, “The jurors in New Mexico who spoke to the media did not hold back in saying that the people on set were responsible for what happened.”

Shortly after returning the guilty verdict, juror Alberto Sanchez spoke to Albuquerque’s KOAT Action News, saying “[they] never did a security check. Never checked round [in the gun] to pull them out to see them, shake them. I mean, if you did that, this wouldn’t happen.” He said that it was “his job to check the rounds,” referring to the new armor, which had only worked on one film set before “Rust.”

Baker believes that Baldwin’s legal team will likely refer to the testimony of the state’s firearms expert, Bryan Carpenter, who has been vocal in his criticism of the way Hannah Gutierrez-Reed handled guns on set.

“He said in his testimony [that] it’s not the actor’s job to check the weapon and if the actor checks the weapon, the shield has to check it again afterwards. Which is consistent with what Baldwin has been saying all along,” said Baker. “The Baldwin problem is the negligent use of firearm components in involuntary manslaughter because every gun expert agrees that you don’t point a gun at someone’s chest and pull the trigger. That is reckless use of a firearm.”

“Baldwin needs to bring in an industry expert who will explain that this is an acceptable standard in Hollywood when you’re handed a gun and told that it’s okay, that the gun safety rules are a little different on a movie set,” he continued. . “I don’t know if the jury will buy it, but that’s what he has to do.”

There is some footage from the trial that may have tainted the potential jury pool, such as the video of Baldwin continuing to fire blank rounds after director Joel Souza had already yelled “Cut!”

“We did see the video of Joel Souza calling ‘cut’ and Baldwin kept firing blanks that made noise and shot powder. And you hear the director calling Baldwin ‘mother-r’ on the video right after Baldwin shot him again,” Baker said. “This will all come up at Baldwin’s trial.”

Alec Baldwin was first charged in January 2023; however, the charges were dismissed without prejudice in April 2023 pending further investigation. “The charges against Alec Baldwin were dismissed without prejudice because the gun’s possible malfunction affected the cause significantly related to Baldwin, not Gutierrez. If it is determined that the gun did not work, the charges against Mr. Baldwin will proceed,” special prosecutors Kari T. Morrissey and Jason J. Lewis wrote in a filing.

In January 2024, they re-filed charges against the actor. He pleaded not guilty. Even though the odds don’t seem in his favor, Baker said that there is little hope for Baldwin to be optimistic. He noted that, through the Hannah Gutierrez-Reed trial, Baldwin’s legal team received “a preview of not only the evidence but also the public perception of Baldwin and that’s a very unique position. They need to watch a preview of his trial.”
