In exclusive court documents obtained by The Blast, a California Calhoun company run by Katie Calhoun — a media relations expert with 20+ years of industry experience — is suing Carey’s business partner (Black Irish’s parent company) — for allegedly not paying her for services.

The Queen of Christmas launched her Black Irish Liqueur line in 2021 with a range of cream liqueurs, explaining that the name represents her Irish and Black roots.

Calhoun, who provides public relations and marketing services for wine and spirits brands, claims that his company was approached by Herzog in September 2022, asking him to help promote the brand, but then failed to pay for his services.

“Herzog leveraged his family connections with Calhoun’s existing clients to establish business credibility with Calhoun, after which he made representations to Katie that he and Carey were business partners who together through Defendant SB owned the Black Irish brand,” the document reads. .

The filing continued, “Herzog intentionally made these representations to induce Katie to extend her company’s business credit and goodwill, and to induce Calhoun to immediately begin work promoting the Black Irish brand without first having a written contract.”

Despite the lack of a contract, Calhoun and his team began work in October 2022 and incurred “external fees,” claims Herzog kept promising he would be paid “soon.” They finally signed a contract in November 2022 with Herzong promising to pay $5,000 a month. The contract also calls for “SB to reimburse the company for extraordinary expenses within 30 days after the submission of the expense report.”

The lawsuit accuses Herzog of struggling to make $5,000 a month and often lying to Calhoun, telling him to “check in the mail.”

“Meanwhile, Herzog made representations that he was good for the money, that his business partner, Carey, was good for the money, and that payment was forthcoming. This statement is false. Herzog made this representation to induce Plaintiff to continue its work in promoting the Brand free of charge while Herzog does not intend to make any further payments to Plaintiff for retainer fees or to reimburse Plaintiff for any substantial costs,” it reads.

PR Company Sues Black Irish For $44,000

The lawsuit launches five causes of action against the “All I Want For Christmas” singer’s company including Breach of Contract, Intentional Misrepresentation, Negligent Misrepresentation, Conspiracy and Ordinary Reckoning of Goods and Services Provided.” Calhoun and his team are seeking compensatory damages in the amount of no less than $44,226.56.
