Mom of tot found dead in septic tank fuming after no charges filed against baby-sitter niece

An Indiana mother is slamming prosecutors’ decision not to charge her 3-year-old daughter’s nanny – who is also her niece – after the toddler was found dead in a septic tank earlier this year.

Jill Humphries said she was deeply saddened that the October death of her daughter, Kenna Wilson, went unpunished.

“I want justice,” Humphries told Fox 19. “I don’t feel any justice has been done. He neglected my son and my son ended up dying in the septic tank.”

On October 19, Humphries, a single mother of three from Versailles, Indiana, went to work after dropping her daughter off with her nephew. A few hours later, he received a panicked call from his sister.

“He was hysterical,” Humphries recalled. “He said there was something wrong with Kenna, he wasn’t moving. They are doing CPR.”

The child was in the care of Humphries’ niece, who is a minor, when she ran away from him and ended up in a nearby septic tank, Ripley County Prosecutor Ric Hertel said.

Kenna had removed the cover covering the tank and either climbed or fell inside, he added.

When the little boy was rescued from the tank, his mother said, he was “ice cold; he had feces in his hair and eyes.”

Kenna was rushed to Norton King Hospital for Girls in Madison, where she was pronounced dead before her mother got there.

“I shook him for probably six and a half hours, until the coroner and the deputy coroner … they promised me that they would take good care of him,” Humphries said through tears.

Kenna Wilson, 3Kenna died on October 19 after climbing or falling into a septic tank while in the care of her mother’s niece.

Kenna’s death was ultimately ruled an accident after it was determined that the young girl showed no signs of injury, and there was nothing to indicate criminal conduct against her.

But her mother said she was saddened that no charges would be filed against her nanny.

“He neglected my son and my son ended up dying in a septic tank,” Humphries said through tears. “He took something from me that can never be replaced.”

The grieving mother, who also lost her sister just two days after her daughter’s death, said she often struggled to get out of bed in the morning to go to work.

Hertel said in a statement that while his heart “goes out to” Humphries, “there were some situations that were terrible accidents.”

Humphries is considering filing a civil suit over Kenna’s death.

The little girl, the youngest of three children, was described in her obituary as “a cheerful and happy little girl.”

“She was full of life, had a great imagination, and loved to swim,” the obituary said. “He would dance to all the little songs he loved. Kenna loves to play with Barbie dolls and her little teddy bear ‘Ted’ brings her joy and comfort.”

Humphries wrote in a recent social media post that he had to “find a way to survive without my beautiful little girl.”

“She was beautiful and angelic until her last breath and I can’t understand how this happened,” he added.
