New video from the set of “Rust” shows Alec Baldwin telling cinematographer Halyna Hutchins to move just before he is shot and killed during a rehearsal on the set of the Western.
The incident occurred on October 21, 2021; however, charges were not filed against Baldwin and shield Hannah Gutierrez-Reed until January 2023. Charges against Baldwin were dismissed without prejudice in the spring as prosecutors continued to build their case against the 65-year-old actress.

On November 16, 2023, a video clip surfaced showing the “30 Rock” actor taking over the set of “Rust” before his gun went off. At one point, he told Halyna Hutchins to stay away, saying, “I don’t want to shoot at you. I want to shoot near you.”
A woman can be heard telling people to stay away, but it’s not clear who the voice belongs to. Hannah Gutierrez-Reed was reportedly not at the church at the time of the rehearsal when Halyna Hutchins was shot and killed. Director Joel Souza, who was standing behind Halyna Hutchins, was also hospitalized as a result of the incident.

The video clip, obtained by NBC News, was taken just days before Halyna Hutchins was killed on set. Even though Baldwin was holding the gun, he insisted that he never pulled the trigger. An FBI analysis of the prop gun conducted last August, however, showed that the trigger had to be pulled for the gun to fire.
Baldwin is listed as an executive producer on the film, although he has insisted that it is only in a creative capacity and claims that he is not responsible for the production on the set of the Western. However, in one of the video clips, Baldwin fired another shot even after director Joel Souza shouted, “Cut!”

Last month, sources told NBC News that special prosecutors are considering filing criminal charges against the actor again as they continue their investigation into the shooting. His charges did not affect the case against Hannah Gutierrez-Reed. The new armor has pleaded not guilty; his trial date is currently scheduled for February 2024.
Sources previously told NBC News that a special prosecutor plans to bring Baldwin’s case before a grand jury in mid-November. According to two separate sources, talks about a plea deal were called off days before the news broke.

A source revealed that prosecutors no longer believed the gun had been modified in a way that would have caused it to go off on its own after additional testing. Instead, the source claims that prosecutors have uncovered new evidence linking Baldwin to alleged recklessness around safety standards on the set of “Rust.”
In a statement, Baldwin’s attorneys, Luke Nikas and Alex Spiro, said, “It is unfortunate that a terrible tragedy has turned into this misguided prosecution,” adding, “We will answer any charges in court.”
In a separate statement, special prosecutor Kari Morrissey said, “We believe that based on our lengthy and detailed investigation that it is appropriate for a grand jury in New Mexico to decide whether the case should proceed.”

And we think about it now, where we have different lives in terms of work. I was really thinking about, you know, I’ve had enough, I mean, I’ve been doing this for a long time and I want to have a personal life.
