According to court documents obtained by The Blast, Tony Bass stated that he was only a few feet away from Nick Carter and Melissa Schumann that night. The incident took place almost two decades ago, in 2003, but Bass can still recount the event in detail while explaining what happened.

According to Bass, the group all met on film sets. The group of four includes Nick, Melissa, Tony, and their mutual friend, Rachel. After a day of filming, the group decided to go back to Nick’s apartment to listen to music and have fun.

“As the night wore on and we were tired, we decided to go to Nick’s bedroom,” Bass wrote in court documents, explaining that they went to Nick’s bedroom because he had musical equipment in his room and wanted to play new music for the foursome. She said that she and Nick’s friend, Rachel, were lying on the floor, just a few steps away. “I remember hearing Melissa and Nick kissing, whispering, laughing, and otherwise playing with each other,” she wrote. “I remember we all laid down together and ended up falling asleep in the bedroom.”

In her own declaration, Rachel said that she “believed” that she left the bedroom and fell asleep on the couch in another room. However, Bass stated that he did not remember Rachel ever leaving the room to sleep on the couch.

After he woke up, Bass noted that the group of four had all left the apartment at the same time. “Melissa testified that Nick was not at the apartment when she left in the morning. I am certain that this is false because Nick never left strangers, which certainly included two women he had just befriended, alone in his apartment,” Bass wrote in the filing.

“I remember leaving the apartment and walking into the parking garage with Nick, Rachel and Melissa. There was nothing awkward or uncomfortable between the group as we said our goodbyes,” she added, saying that “At no time throughout the night did I observe Nick act inappropriately towards Melissa or Melissa but flirtatiously engage with Nick. .”

The most recent motion filed was in opposition to Melissa Schuman’s anti-SLAPP motion in Nick Carter’s counterclaim against Schuman and her father, Jerome.

A judge recently ruled in favor of Nick Carter in an anti-SLAPP motion filed by Shannon Ruth, saying that Carter was allowed to pursue his counterclaim against Ruth based on the evidence he submitted for the anti-SLAPP hearing and Ruth’s failure to provide sufficient evidence to support an anti-SLAPP motion.
