The Carter family is fighting a legal battle over custody of 9-year-old daughter Bobbie Jean Carter.
According to legal documents, obtained by The Blast, Nick and Aaron Carter’s mother — Jane Schneck tried to get full custody of Bobbie’s child in the weeks after her tragic death.
In the filing, Jane and her husband, Gregory, asked the court to order the child, whose mother died in December, to remain in their custody instead of the “non-relative” Bobbi reportedly abandoned before her death. .

In the emergency petition, Jane and Gregory filed on January 17, they stated that they are the most suitable candidates to be granted temporary custody because (the minor) has lived with them all his life, and his mother is deceased.
The maternal grandparents also stated that the preteen’s alleged father, Richard Marreo-Campos, was not listed on her birth certificate, and that they never established paternity or ordered child support. Sadly, he passed away seven years ago.
The filing outlines that even though Bobbi Jean’s death made her consent unavailable, she had entrusted her daughter to someone named Yvette Rodriguez before she died.
However, Yvette – who is not a relative and had minimal contact with the child prior to her mother’s death, does not want to release the child to Jane and Gregory.

But, Yvette is now opposing Jane’s petition, and a court date is set for March 15, 2024, to determine custody.
Mrs. Carter’s filings show she has spent significant time with her grandparents over the past year, having her own room with all her belongings in their home.
Despite the lack of written documentation that would allow her and her husband to make the necessary decisions for her, Jane requested temporary custody until their granddaughter turned 18 or was no longer dependent.
They think it is in the child’s best interest because of his close bond with them, having lived with them in the stability of their home.
Interestingly, a temporary order was granted, and the child is now living with the Carter family. A hearing is set for March to address making the permanent order. As for Yvette, he claims she is his “paternal aunt” and has filed a motion to intervene and void the temporary custody order.
Yvette insisted that the child had been living with her since last August and that the child had been taken from her care on the day the temporary custody order was granted to Jane and the Carter family.
The alleged paternal aunt claims to have a signed written consent from Bobbie Jean to care for her daughter before her death. He also stated that he had educational custody of the child, who was enrolled in school and excelling academically.
Additionally, he mentioned that the 9-year-old’s cell phone number had been changed, and contact with him had been severed. Yvette also claimed that Jane and Gregory did not meet the statutory criteria required to file for temporary custody.
Clearly, this is shaping up to be a legal battle.

Amid the legal custody battle, it is worth noting that the sudden death of his mother marks the third tragedy for the Carter family, following the death of Aaron at the age of 34 in November 2022 and the death of Leslie at 25 in January 2012.
The aftermath of the tragedy leaves Jane in disbelief and grief as she reveals that her daughter’s death has left her without a parent. In his statement, he delivered:
“I was shocked to learn of the sudden death of my daughter, Bobbie Jean, and I will need time to process the terrible reality of this happening for the third time. [H]Although a parent feels the loss of a child deeply, the suffering of a small child due to the loss of a parent must be greater.”
After pleading with the audience to “say a prayer” for her “precious eight-year-old granddaughter,” the Carter parent added, “When I can think clearly, I will release a fuller statement, but until then, I will ask to be left to grieve privately.”
