New York Attorney General Letitia James filed a motion on Tuesday asking a judge to impose legal sanctions on former President Donald Trump, his children and his legal team for “frivolous conduct” in a $250 million fraud lawsuit against him and his company.
James argued Trump, 77, and the other defendants should collectively be forced to pay $10,000, and their lawyers an additional $10,000, for repeatedly using legal arguments that have been thrown out several times by the judge overseeing the case, according to court documents.
“Courts have discretion to ‘impose monetary sanctions on any party or attorney in a civil action or proceeding engaged in frivolous conduct,’ and may impose sanctions on both,” the Attorney General’s office argued in a Manhattan Supreme Court filing from Tuesday.
“Here, the lack of legal basis for Defendants’ standing, capacity, denials, and rebuttal arguments should have been apparent to Defendants and their counsel from this Court’s and the First Department’s decisions,” the motion continued. “Under these circumstances, the Court should impose sanctions on the Defendants and their lawyers.”

Trump argued in October 2022 that the Attorney General’s office did not have the right to bring the sweeping lawsuit against him, his company the Trump Organization and sons Eric and Donald Trump Jr. – but the motion to dismiss the case was overruled by Manhattan Supreme Court Justice Arthur Engoron.
Engoron denied a second motion to dismiss from November 2022 that used the same three arguments, finding it “borderline frivolous even the first time the defendant made it,” and adding “Trump’s sophisticated defense attorney should have known better,” the AG argued.
The judge also warned Trump’s team it could face sanctions when it rejects the second motion to dismiss, but did not impose any at the time.
The Attorney General’s Office said the same argument was used again by the Trump team in filings on at least three other occasions on February 7, August 4 and September 1 this year. The two most recent motions have yet to be decided.

The lawsuit seeks to halt Trump’s ability to do business in New York and prohibit him and his team from buying commercial real estate for several years.
“Donald Trump falsely inflated his net worth by billions of dollars to unjustly enrich himself, and cheated the system, thereby cheating us all,” James, a Democrat, said at a press conference at the time.

“Claiming you have money you don’t have is not the art of the deal, it’s the art of stealing,” he said, referring to Trump’s 1987 book.
James’ office – which investigated the Trump family for three years – said they had uncovered possible criminal violations, including falsifying business records, insurance fraud, issuing false financial statements, conspiracy and bank fraud.
