The gun held by actor Alec Baldwin went off, though the “30 Rock” actor insisted that he did not pull the trigger. The bullet hit and killed cinematographer Halyna Hutchins and wounded director Joel Souza.

Hutchins’ family filed a wrongful-death suit against Baldwin and other “Rust” producers in February; however, by October, they were done. Matthew Hutchins, her husband, will serve as executive producer for the film, which is expected to resume production soon.

A 551-page police report conducted by the Santa Fe police department was released to the public a month later; however, it still doesn’t answer many questions left by the fatal shooting, such as how live bullets ended up on film sets.

The case has been turned over to the Santa Fe First Judicial District Attorney’s Office, which will make the final decision when it comes to charging the individuals they believe will be involved.

A source told TMZ that a decision on whether or not to file charges against Baldwin — or anyone else — in the case, will be announced later this month.

DA Was Given Over $300K To File Charges

Late last year, Deadline reported that Santa Fe District Attorney Mary Carmack-Altwies had sent a letter to the New Mexico Finance Board asking for $635K to prosecute four individuals on felony and murder charges related to the Rust tragedy. In the end, Carmack-Altwies was only awarded $317,750.

In the letter, the DA said, “one of the possible defendants is famous movie actor Alec Baldwin.” However, Baldwin’s attorney, Luke Nikas, responded to the letter, saying “it would be premature to discuss the case because they have not yet reviewed the file or discussed the outcome of their charges.”

“It would be irresponsible to report otherwise,” added Nikas. “The DA has made it clear that he has not received the sheriff’s report or made any decisions about who, if anyone, might be charged in this case.”

In the 551-page report of the Santa Fe police department, director Joel Souza describes in detail what happened on the day of the shooting. Souza told police that first assistant director Dave Halls was in charge of gun safety on the “Rust” set.

On the day Hutchins was shot, Joel said he remembers Dave announcing that it was a “cold gun,” meaning it was a gun that did not contain live ammunition, before the crew broke for lunch.

Souza said he wasn’t sure who brought the gun to the set, but noted that the incident did not require Baldwin to draw his firearm. The report reads: “Joel explained that the shooting required Alec to slowly pull out the gun and remove part of it from the holster. When asked if the shooting required Alec to fully remove the gun and point it, Joel stated ‘no’ because they didn’t get that far.”

Documentary About Halyna Hutchins’ Life At Work

In November, Deadline announced that Story Syndicate will produce a documentary that will focus on the life of cinematographer Halyna Hutchins. The feature will reportedly explore his life, his famous works, and his sudden death on the set of a Western in New Mexico.

The film will be directed by Emmy-nominated filmmaker Rachel Masson and will be produced by Julee Metz. At this time, no further details have been announced about the untitled documentary.
