Kim Zolciak and Kroy Biermann’s latest trial in their divorce case was deemed a “waste” by the presiding judge after the “RHOA” star failed to show up for the hearing.
According to witnesses in the courtroom, Biermann’s lawyer pushed to sell the ex-lover’s house in Georgia. As you know, the argument came just days after Zolciak filed a motion to dismiss Biermann’s second divorce filing. The former couple previously announced their split in May, but by July, they had “reconciled”.

During the hearing in Fulton County Superior Court, all parties except Zolciak were present. As her lawyer David Beaudry explained, the blonde beauty was unable to attend because she was returning from filming the MTV reality series “The Surreal Life” in Colombia — and was expected to land in Atlanta around 9pm local time.
Despite repeated apologies from Beaudry, the judge expressed annoyance and firmly reiterated that he was not allowing the reality television star to skip the trial.
“His presence has not been ruled out for today, so he should be here. I do not rule out his presence,” said the judge.

A tense exchange prompted the judge to temporarily halt the proceedings, according to reports. Upon resuming, the judge, still visibly irritated, decided to reset the hearing and eliminate the option to appear via Zoom. He insisted that in the future, all parties involved in the case would be required to be physically present in his courtroom.
Although Judge Williams’ decision appeared to upset all participants, it did not stop Biermann’s attorney, Marlys Bergstrom, from shifting focus to an emergency motion, asking the court for permission to sell the family’s $3 million home in Alpharetta, Georgia.
During these discussions, it was revealed that Zolciak refused to list the estate for sale, and it is now scheduled for foreclosure on November 7th. Biermann later confirmed this information when he spoke for the first time during the trial, saying, “Right. “
When the judge asked if the “Real Housewives of Atlanta” alum’s attorney knew about the pending foreclosure, she replied, “No, judge, I don’t know that.” Meanwhile, when asked about the home equity estimate, Biermann declined to answer, citing concerns about media coverage of the hearing.
The former Atlanta Falcons linebacker previously cited the foreclosure in legal documents when rejecting his estranged wife’s request to dismiss her divorce filing. In a paper obtained by The Blast a few days ago, he stated:
“The applicant has no desire to reconcile. The fact that she had sexual relations with the Respondent does not indicate a desire to reconcile. The Petitioner, after this second filing, remains steadfast in his desire to divorce the Respondent, and leave the conjugal residence, even though the house is now in pre-foreclosure.”

Biermann, who called Zolciak’s initial petition a “legal game,” added that “filing the motion is just another delaying tactic in Respondent [Zolciak]playbook as indicated by his exclamation “I’m staying here going nowhere!”
Ex-Partners Engaged in More Than One Legal Battle
Biermann and Zolciak’s ongoing divorce proceedings recently took a significant financial turn when Target National Bank filed a complaint alleging that the latter had neglected to pay a $2,482.24 credit card fee. As we reported, records show the 45-year-old opened the card in December 2007 but stopped making payments in September 2022, despite a final payment of $500.
To try to resolve the issue, the financial institution has taken over the account and is actively conducting debt collection. To date, Zolciak has not responded to these allegations, making it uncertain whether he intends to resolve the dispute anytime soon.
With this latest problem, it looks like the financial challenges for the estranged couple are getting worse, as they are dealing with a huge debt to the IRS, totaling over $1 million. The loss amount includes unpaid taxes, interest and penalties from 2013, 2017 and 2018.
Additionally, Biermann has his own lawsuit from Sky Warrior, the credit line operator for the Baha Mar Casino in the Bahamas. According to legal documents, the Montana graduate allegedly earned a $100,000 credit for his November 2021 casino trip, of which he spent $52,500 on gambling.
