Instead, she works more as a personal assistant. His employment ran from January 10, 2022, until July 11, 2022, when he was “involuntarily terminated.”

She claims things went awry with her job when she told Lowe about her disability and asked for an accommodation for the illness. The former employee claimed his disability was being treated by a licensed health care provider who recommended he be off work for a month.

However, he claims that when he presented the medical recommendation to Lowe, he lost his job.

“He provided the document to (Lowe) on July 7, 2022. On July 11, 2022, Plaintiff’s employment was terminated,” the document reads.

At the time, it appeared that the person was struggling with physical and mental illness.

In addition to the discrimination claim, the former employee claims Lowe’s failed to pay her for overtime even though she spent many hours working from home and on weekends.

The woman said her annual salary is $100,000 with an hourly rate of $48.07. However, he allegedly worked approximately 30 hours of overtime per week without receiving overtime compensation or double.

He is seeking $87,823.89 in unpaid overtime plus benefits, $12,498.20 in unanswered meal period wages and $17,305.20 in punitive damages awards under CA Labor Code 203. The former employee also asked Lowe to pay his attorney’s fees and costs.

Lowe has since responded to his former aide’s claims, denying them outright.

“The plaintiff’s discrimination claim is equally without merit. He never disclosed any alleged disability until after he stopped reporting for work. Despite this, he failed to disclose any information about the nature or scope of his alleged disability that prevented the Defendant from providing (or discussing) a reasonable accommodation,” his lawyer said.

He claimed the aggrieved employee simply ignored repeated phone calls and demanded a month’s leave.
