The state is looking to continue its investigation into the October 2021 shooting of “Rust” cinematographer Halyna Hutchins.

Although charges against actor Alec Baldwin, who fired the gun, were filed in January 2023 and dropped in April 2023, the special prosecutor revealed that it is still possible he may face charges as they continue their investigation.

It looks like they’re getting closer to a decision as they continue to build their case against Hannah Gutierrez-Reed’s “Rust” shield. The rookie shield trial was originally scheduled for December 2023 but will now take place on February 21, 2024.

In the latest development in the “Rust” case, special prosecutors are trying to determine why Hannah Gutierrez-Reed may have been denied additional weapons training and how a “motive” for that decision may have played a factor in her criminal case.

On Tuesday, October 3, 2023, The Blast received new court documents filed by the state of New Mexico regarding the protective order and subpoena. Court documents state that “Baldwin was a producer on the show and was heavily involved in the development of the script and other aspects of the film, and was personally involved in the firearms training provided by Ms. Gutierrez.” Although the court documents refer to Baldwin as a producer on the “show” it is clear that they are talking about his involvement in the Western film, directed and written by Joel Souza.

In the court filing, it further said that, “Ms. Gutierrez claims he made a request for an additional armor day and additional time to provide Mr. Baldwin with firearms training,” meaning that “Rust” armorer requested an additional day to train Alec Baldwin on how to handle a firearm and was denied. “Ms. Gutierrez asserts that she believes this request was denied for financial/budgetary reasons,” the document added.

“This is an appropriate inquiry for the State to explore by reviewing the agreements between Mr. Baldwin and the various production companies to determine whether there were financial or other considerations involved in the decision to deny Ms. Gutierrez working additional shield days and/or prepare days. additional training to Mr. Baldwin,” the court filing said. “For example, Mr. Baldwin’s agreement will most likely require him to receive a certain amount of compensation for each day of filming or for each day of performing tasks related to filming, such as firearms training.”

The state of New Mexico said it “should be allowed to explore” if Hannah Gutierrez-Reed’s request for additional firearms training was “denied for financial considerations” and “not for safety or other reasonable considerations.” The State claims that the “motive” that played into the decision to deny the armorer training time is important to its criminal case because it determines how it might affect the armorer’s ability to perform his duties.

“Also, Mr. Baldwin’s contract may stipulate that he receive a percentage of the profits from the film, again indicating that financial gain may have impacted Ms. Gutierrez’s ability to perform her duties as a shield,” the document states. “As this Court is well aware, the special prosecutor has a duty to investigate potentially exculpatory evidence, and for Ms. Gutierrez, if it turns out to be true, it is exculpatory.”

Armorer ‘Rust’ Fails to Get Charges Against His Firing

As The Blast previously reported, Hannah Gutierrez-Reed’s legal team is trying to get the charges against her dismissed after the shield made headlines earlier this summer for new charges of tampering with evidence.

Although he was initially charged with two counts of involuntary manslaughter in connection with the death of Halyna Hutchins in January 2023, he was later charged with tampering with evidence after he allegedly passed bags of cocaine to another individual on the set of “Rust” while police conducted their investigation into Hutchins’ death.

Gutierrez-Reed’s legal team is trying to get the charges against him dismissed, claiming that the headlines surrounding the new charges could taint a potential jury pool. However, District Court Judge Mary Marlowe Sommer disagreed and did not feel that public opinion would be influenced by the information that had been released by the media.

After failing to get the charges dismissed, Hannah Gutierrez-Reed entered her not guilty plea on August 7. His statement read: “Having read and understood the above, I hereby waive my right to appear in person at the District Court for trial and I hereby plead not guilty to all criminal offenses charged in the cause styled above.”
