The producers of “Rust” are trying to dismiss the medical suit that has been filed against them. The physician, Shannon Hughes, whose last name is actually DeLap, is a contractor for the Bonanza Creek Ranch in New Mexico, where “Rust” was filmed.

On October 21, 2021, cinematographer Halyna Hutchins was shot and killed when a gun held by actor Alec Baldwin went off during a scene they were rehearsing. Director Joel Souza was hospitalized as a result of the incident.

According to court documents, Hughes was having lunch with his co-workers when they heard gunshots. He asked them if training was going on at that time and immediately ran towards the church. He said he heard a “panic call for a doctor” on his radio as he ran. When he entered the church, he saw that Halyna Hutchins and Joel Souza had been seriously injured.

Hughes administered emergency treatment to Hutchins until first responders arrived. Medical experts opined that the incident caused him “shock, trauma, and severe emotional distress” that left him unable to work. He sued Bonanza Creek Ranch for negligence, saying that the injuries Hutchins and Souza suffered caused him emotional distress.

However, the plantation owner tried to have the case dismissed, insisting that his claim was based on the bystander law. It should be noted that Hughes was not injured in the shooting and did not witness it, as stated in his petition.

Meanwhile, the new shield faced an additional charge of tampering with evidence in June after a witness came forward claiming he transferred cocaine to another individual on the day of the “Rust” shooting, interfering with the police investigation. He pleaded not guilty and his trial is set for February 2024.

In early June, special prosecutors stated in a legal filing that they would decide whether or not to charge Baldwin again within sixty days. However, it wasn’t until October that a source familiar with the investigation told NBC News that New Mexico prosecutors intended to charge Alec Baldwin again.

If they renew the involuntary manslaughter charge, that would be designated as a fourth-degree felony in New Mexico, which carries a maximum sentence of 18 months in prison and a fine of up to $5,000.

Luke Nikas, an attorney for Baldwin, said in a statement, “It is unfortunate that a terrible tragedy has turned into this misguided prosecution. We will answer any charges in court.” Although Baldwin continually denied pulling the trigger, FBI tests maintained the trigger had to be pulled in order for the gun to fire.
