Actor Alec Baldwin is making headlines again because of the criminal case against the 65-year-old actor in connection with the death of “Rust” cinematographer Halyna Hutchins.
In October 2021, the gun the “30 Rock” actor was holding exploded, striking and killing the cinematographer. Director Joel Souza, who was standing behind Hutchins, was hospitalized as a result of the incident.
In January 2023, prosecutors charged Baldwin and armorer Hannah Gutierrez-Reed with two counts of involuntary manslaughter. Gutierrez-Reed was later charged with tampering with evidence after prosecutors claimed they found a witness who claimed the shield transferred cocaine to another person on the day Hutchins was killed. He has pleaded not guilty. His trial is scheduled to begin in February 2024.
Charges were dropped against Baldwin in April 2023 and refiled in January 2024.

While many argue that Alec Baldwin should be criminally charged for portraying Halyna Hutchins in 2021, SAG-AFTRA has come to the actor’s defense, insisting that it is not a performer’s job to know how to handle a firearm, especially since guns are not supposed to contain live ammunition and Baldwin does not load the gun itself.
On Thursday, SAG-AFTRA released a statement on their website, stating, “To the extent that the charges filed on January 19th are based on allegations of negligent use of firearms based on this or any actor having a duty to check firearms. as part of its use, it’s a misjudgment of an actor’s real job on set.”
“An actor’s job is not to be an expert on firearms or weapons. Firearms are prepared for use on set under the guidance of several professional experts who are directly responsible for the safe and accurate operation of the firearm,” they continued, noting that “Industry Standards for safety with firearms and the use of blanks are clearly laid out in Safety Bulletin 1, prepared by the Joint Industry-Wide Labor Management Safety Commission.”

They went on to explain that “The guidelines require an experienced and qualified armorer to be assigned to handle all handling, use and storage of firearms on set. These duties include ‘checking the firearm and barrel before and after each firing sequence,’ and ‘checking all firearms before each use.’ So it looks like they’re putting the blame squarely on Hannah Gutierrez-Reed’s shield, whose trial is set to begin next month.
“The guidelines do not make it the perpetrator’s responsibility to check any firearms,” the statement added. “Performers train to perform, and they are not required or expected to be experts in firearms or experienced in their use. The industry leaves that responsibility to qualified professionals who oversee its use and handling in every aspect. Anyone who discharges a firearm on set must be given training and guidance in its safe handling and use, but all activities with firearms on set must be under the close supervision and control of professional armorers and employers.”

On Wednesday, Baldwin’s attorneys, Luke Nikas and Alex Spiro of Quinn Emanuel filed a legal motion seeking a speedy trial for their client.
