The 17-year-old allegedly fired five shots into Wagner’s head and neck at point-blank range “without saying a word.”

“The defendant’s senseless conduct against a stranger strongly suggests that if released on his own recognizance or with low bail, he will commit future violent crimes,” Burke wrote in asking that bail be set at $3 million prior to the suspect’s arrest.

A friend who was with Rivera Dominguez on the bus later told detectives that he did not warn that the 17-year-old was going to shoot dead a sleeping passenger, whom they did not know, according to charging papers.
