AUSTIN, Texas – A pregnant Texas woman who sought court permission for an abortion in an unprecedented challenge to one of the strictest bans in the US has left the state to seek the procedure, her attorney said today.
The announcement comes as Kate Cox, 31, awaits a decision from the Texas Supreme Court on whether she can legally obtain an abortion under a narrow exception to the state’s ban. A judge granted Cox the go-ahead last week, but the decision was put on hold by the state’s statewide Republican high court.
“His health is on the line. She’s been in and out of the emergency room and she can’t wait anymore,” said Nancy Northup, president and CEO of the Center for Reproductive Rights, which represents Cox.
The organization did not disclose where Cox went.
Cox is believed to be the first woman in the US to seek court permission for an abortion since Roe v. Wade was overturned last year. His lawsuit quickly became a high-profile test of the ban in Texas and a dozen other GOP-controlled states, where abortion is banned at nearly all stages of pregnancy.
Days after Cox filed her lawsuit, a pregnant woman in Kentucky last week also asked the court to allow an abortion. There has been no decision yet in the case.

Doctors had told Cox that her fetus was at high risk for a condition known as trisomy 18, which has a very high chance of miscarriage or stillbirth, and a low survival rate, according to the lawsuit.
They also told Cox that inducing labor or carrying the baby to term could affect her ability to have more children in the future.
