Former President Donald Trump has given up on winning his $250 million civil fraud trial in New York and is instead focusing on spinning issues to secure his position as the leading GOP presidential candidate, according to a leading legal commentator.
John Yoo, a former Bush administration official, said that while Trump has protested that he will beat allegations of improperly raising his wealth, the 77-year-old former commander-in-chief has already “thrown in the towel” on the trial. starting Monday morning.
“I think Trump has already decided he’s going to lose the law,” Yoo told Fox News, citing Judge Arthur Engoron’s sweeping ruling last week in favor of Attorney General Letitia James’ major fraud claim.
In a 35-page ruling, Engoron ruled in favor of James and revoked the former president’s New York business license, which could have hindered his old company’s ability to operate in the Empire State.
“So what I think President Trump has done is turned this all into a political strategy,” Yoo continued.

Before the trial began, Trump branded James a “racist” and Engoron an “unfair, disaffected” judge who was biased against him.
“This is a judge who should be out of office. This is a judge that some people say could be criminally charged for what he did,” Trump said during a court break in the afternoon. “He interfered in the election and it’s a shame.”
Yoo described Trump’s rant as an “acceptance speech at the Republican National Convention,” noting that bashing the judge would do nothing to help his legal position in the case.

“Attacking judges for being crooks, saying the press, the chief prosecutor, the attorney general, is racist. Now, there’s no way this judge is going to find at all in favor of President Trump,” Yoo said.
All of these difficult discussions, Yoo said, were instead “all aimed at the political sphere.”
The legal scholar also doubted that Trump would prevail on appeal, claiming that the judge would avoid the case or avoid overturning the facts presented at trial.
With no hope of winning, Yoo said Trump is instead focusing his efforts on undermining the Democratic urban legislative system to play to his base.
“So I think what you’re seeing here is actually throwing on the law and using it as a platform to amplify his political message,” the legal expert speculated.
According to a poll conducted exclusively for The Post following Wednesday’s second Republican primary debate, Trump remains the frontrunner for the GOP presidential ticket.
The poll of 1,303 people, conducted by Leger, found that 62% of GOP voters want to see the former commander-in-chief emerge as the party’s nominee.

Yoo predicted the trial, which is expected to last until the end of December, will see more Trump lashing out at the judge and the prosecution.
While he said Trump would be the clear loser in the case, Yoo acknowledged that New York City won’t really win either — with the case risking labeling the trade center as a place conservative-owned businesses should avoid.
The fraud lawsuit brought by James accuses Trump, sons Eric and Don Jr., and the Trump Organization of a decades-long scheme to inflate the value of their assets and save them millions in loans and insurance.
