More Republicans on Capitol Hill turned on the latest Senate border deal on Monday, taking issue with more than $20 billion earmarked to effectively speed up the processing of migrants to the US — as former President Donald Trump called it “a great gift to Democrats.”
“I cannot support a bill that does not secure the borders, provides taxpayer-funded lawyers to illegal immigrants and gives billions to radical open borders groups. I do not,” said National Republican Senatorial Committee chairman Steve Daines (R-Mont.).
“President Biden should instead use his executive powers to restart the Trump policies he canceled: Stay in Mexico, Title 42, Building the wall,” the Montanan added.
The bill includes $650 million in funding for the construction of a southern border wall and Title 42-style authorities to close the border when migrant crossings exceed an average of 5,000 a day over a one-week period.
But GOP border hawks have taken issue with the authority in the hours since the text was released Sunday night, pointing out that asylum seekers can still be processed at the gate and that the president can also suspend the provision if he deems it in the “national interest.”

Sen. JD Vance (R-Ohio) noted that Sen. Chris Murphy (D-Conn.) — one of the three co-legislators of Sen. James Lankford (R-Okla.) and Kyrsten Sinema (I-Ariz. ) – have acknowledged “borders are never closed” under the proposed law.
“Biden can say anything is in the ‘national interest’ and thus suspend the ‘border emergency authority.’ Don’t pretend to be surprised when he does,” Senator Mike Lee (R-Utah) added. “Or better yet — don’t let go of this hot mess!”

In a subsequent post, Trump added: “The ridiculous ‘Border’ Bill is nothing more than a very sophisticated trap for Republicans to blame what Radical Left Democrats have done to our Borders, just in time for our Election most important. . Don’t fall for it!!!”

In December, US Customs and Border Protection found a record-breaking 302,034 immigrants trying to enter the country through the southern border, meaning nearly 10,000 are stopped each day.
“Currently, if the border is conquered, default [position] is, ‘Let everyone into this country.’ This changes the paradigm 180 degrees. When the border is overrun, everyone is sent home,” Lankford told reporters in a phone call Sunday night, adding that it would remain closed for three weeks.

He added that other changes to the “catch and release” policy would help with the immediate removal of asylum seekers who do not have a valid claim, with enhanced screening of immigrants for threats of violence and crime and deportation within 90 days, not years, if they are not do it meet the standards.
The increased funding will also provide more Immigration and Customs Enforcement agents and provide 50,000 more beds for immigrant processing, reducing the backlog of 3 million asylum cases.
Some of the most controversial provisions, which comprise a large subsection of the $118 billion total emergency national security package requested by the president, have already been leaked in the past month – including the president’s emergency authority, legal counsel for unaccompanied migrant children and their who are deemed mentally incompetent, and funds for non-governmental groups that help illegal aliens.
The final item totaled $1.4 billion from the Federal Emergency Management Agency for NGOs to provide shelter and other services, which Sen. Bill Hagerty (R-Tenn.) said would use taxpayer money “to buy Democratic shelter mayors” like New York’s Eric Adams.

“The ‘border’ bill released tonight includes $1.4B that attracts NGOs to resettle illegal immigrants in your community through plane tickets and hotel rooms (nearly double the record amount from FY23), including $933M available as well -immediately unconditionally,” Hagerty said.
Homeland Security Secretary Alejandro “Mayorkas has refused to provide transparency to Congress about the program, but this bill rewards him with record-level rewards. This is unacceptable,” added the Tennessean.
Another controversial move shifts judicial review of asylum determinations and executive emergency authority to the District of Columbia — the jurisdiction currently leading Trump’s 2020 election meddling case.
Some Senate GOP staffers see this as a victory over giving such cases to other Democratic-leaning courts in the states of Washington, Oregon, California and Maryland — but others call the DC Circuit an equally flawed jurisdiction.
“Certain legal challenges to the bill would need to go through the District Court for the District of Columbia, which would completely eliminate the judicial circuit that has historically handled border issues,” Sen. Eric Schmitt (R-Mo.) said in a statement. “This bill empowers non-judicial officials, who favor the Biden Administration’s desire for open borders, to decide asylum claims, bypassing the immigration court system and further opening the floodgates and deepening the crisis at our border.”
Both Biden and Mayorkas praised the legislation, with the former pledging to sign it into law if it passes the House and heads to his desk and the latter calling it “tough” but “fair.”
But the House Republican leadership said any consideration by the Senate was “a waste of time,” citing the further entry of 50,000 work visas for immigrants and Mayorkas’ track record of using his authority “to keep the borders open.”
“American sovereignty is at stake,” said House Speaker Mike Johnson (R-La.), Majority Leader Steve Scalise (R-La.), Majority Whip Tom Emmer (R-Minn.) and GOP Conference Chairwoman Elise Stefanik (R-NY ).

“Any consideration of this Senate bill in its current form is a waste of time. DEAD on arrival at Home. We encourage the US Senate to reject it.”
Daines added in a statement Monday that “with House Republicans united against this bill it makes no sense to bring it up in the Senate” and vowed to vote “no” if it were brought to the floor this week.
The measure needs 60 votes to clear a filibuster, but a Senate aide told The Post that public opposition from Ukraine peddlers like Foreign Relations Committee ranking member Jim Risch (R-Idaho) indicated the measure could fail before that on a procedural motion — and not be taken up again.
Senate Majority Leader Chuck Schumer (D-NY) has said he will call up the bill on Wednesday, but the House has prepared an impeachment vote against Mayorkas for the time being.
If the latter is approved, it would trigger an immediate Senate hearing to determine whether to convict, potentially hampering moderate Republicans’ chances of persuading their reluctant colleagues in the upper chamber.
