Butler said the crash threw him off his motorcycle and into Sherman’s vehicle and back onto the pavement. He claims the force of the impact caused him to suffer “catastrophic injuries.”
Paramedics arrived at the scene and treated him before taking him to a nearby hospital.
Butler spoke of the lawsuit to PEOPLE, saying “I’m lucky to be here. I went 33 feet in the air.”
He continued, “I did a somersault,” and he said he had “five fractures in my right leg alone, because I landed right on my knee, so I was kneeling and my left leg. And this is the busiest period in my career.”
Butler is willing to settle the entire case for $2.25 million, and will dismiss the claim entirely. He will return to court in December this year to determine whether the case will go to trial. Leah Sherman has a few weeks to decide if she will accept Butler’s offer.

This accident is not the actor’s first close call with death.
In 2011, Butler was rescued from the ocean following a surfing accident.
The actor was pulled underwater and dragged onto a rocky reef in 2011 by a large set of waves while he was filming the surf movie “Of Men and Mavericks.”
He was taken to hospital, but left without serious injuries.
Butler was a brave man.
She told Seth Meyers she’s a fan of risky behavior, even injecting herself with bee venom — twice!
“I don’t know what I was thinking,” Butler said, noting that she met with her nutritionist after experiencing some painful inflammation. “He goes, ‘look at this! This is probably about 2.3 bee stings.’ And he gave me a shot in the arm.”
Butler stated that he felt fine after the initial injection.
“So he gave me another ten! Basically 23 bee stings,” admitted the actor.
