Actor Alec Baldwin is again facing charges for shooting “Rust” cinematographer Halyna Hutchins in October 2021. Both the actor and “30 Rock” shield Hannah Gutierrez-Reed were charged with two counts of involuntary manslaughter in January 2023; however, in April 2023, the charges against the actor were dropped without prejudice.
Gutierrez-Reed continues to face charges as special prosecutors continue their investigation; weeks after dismissing the charges against Baldwin, prosecutors charged Gutierrez-Reed with an additional charge of tampering with evidence after they claimed a witness came forward to say he had transferred narcotics to the individual on the day Hutchins was killed, hindering the police investigation.
His trial has been postponed from December 2023 to February 2024.
Alec Baldwin Has Been Charged With Involuntary Manslaughter Again

Just a year after Alec Baldwin was indicted on two counts of involuntary manslaughter, the “30 Rock” actor is being charged again. The 65-year-old actor now faces just one count of involuntary manslaughter, which still carries a prison sentence of up to 18 months if convicted.
According to the charges, filed on January 19, 2024, Baldwin now faces one count of involuntary manslaughter (negligent use of a firearm) in connection with the death of Halyna Hutchins. The filing states that Baldwin “did cause the death of Halyna Hutchins by acts performed with complete disregard or disregard for the safety of others, and the acts were such that an ordinary person would expect that death might occur under the circumstances.”
A grand jury issued the indictment Friday by special prosecutors Kari T. Morrissey and Jason J. Lewis, who were assigned to the case last year after initial charges were dismissed without prejudice in April 2023.
Special Prosecutor ‘Rust’ Dismisses Charges Against Alec Baldwin Without Prejudice April 21, 2023

On April 21, 2023, the State of New Mexico formally dismissed the charges against Alexander Rae Baldwin III in the First Judicial District Court of Santa Fe County. The official document reads:
“COMING NOW the State of New Mexico, by and through special prosecutors Kari T.Morrissey and Jason J. Lewis, and entering nolle prosequi in the causes numbered and styled above, because new facts have come to light which demand further investigation and forensic analysis which cannot resolved before May 3, 2023, preliminary hearing. The case was dismissed without prejudice and the investigation is active and ongoing.”
At the time, the charges were dismissed without prejudice, meaning he could face future charges as a special prosecutor continues to investigate the fatal shooting of cinematographer Halyna Hutchins.

Special prosecutors Kari Morrissey and Jason Lewis issued a statement explaining that they could not prosecute Baldwin given the time constraints before bringing the case to trial. A statement (via Deadline) from two “Rust” prosecutors read:
“Over the past few days and in preparation for the preliminary hearing on May 3, 2023, new facts have come to light that demand further investigation and forensic analysis in the case against Alexander ‘Alec’ Rae Baldwin, III. Therefore, we cannot proceed under the current time constraints and based on the facts and evidence submitted by law enforcement as they stand. Therefore, we will dismiss the charge of involuntary manslaughter against Mr. Baldwin for further investigation. This decision does not absolve Mr. Baldwin of criminal wrongdoing and charges can be refiled. Our follow-up investigation will remain active and ongoing.”
At the time, they also clarified that charges had not been dropped against Hannah Gutierrez-Reed’s “Rust” shield, saying, “The charges against Hannah Gutierrez-Reed remain unchanged.”
Family of Halyna Hutchins ‘Hopeful’ Baldwin Will Face More Charges

In February 2023, Hutchins’ mother, Olga Solovey, her father Anatolii Androsovych, and sister Svetlana Zemko, filed a lawsuit against Alec Baldwin, the producer of “Rust”, and a handful of other companies and individuals alleging negligence that resulted in Halyna’s death.
After the charges were dropped, attorney Gloria Allred, who is representing the family, released a statement saying her client “remains hopeful” that Baldwin will still face criminal charges.

“Mr. Baldwin could pretend that he wasn’t responsible for pulling the trigger and firing the live bullet that ended Halyna’s life,” he said in a statement. “He could have run off to Montana and pretended that he was just an actor in a Wild West movie but , in real life, he can’t escape the fact that he has a major role in a tragedy that has real-life consequences.”
Gloria Allred also represented “Rust” script supervisor Mamie Mitchell in a lawsuit she filed against Baldwin and other “Rust” producers in November 2021.
