Actor Alec Baldwin and “Rust” actress Hannah Gutierrez-Reed each face two counts of involuntary manslaughter in the death of cinematographer Halyna Hutchins.
Hutchins was killed on the set of the Western film in October 2021. The police investigation was completed the following year and the Santa Fe District Attorney officially filed charges against both individuals on Tuesday, January 31.

According to ABC affiliate KOAT, Alec Baldwin, Hannah Gutierrez-Reed, and first assistant director Dave Halls, who pleaded guilty to negligent use of a deadly weapon, will all be arraigned later this month.
On Friday, February 24, the first set of court hearings for the three defendants was scheduled in the First Judicial District Court in Santa Fe with District Court Judge Mary Marlowe Sommer presiding.

The Administrative Office of the Court has said that they do not have to appear in person and that they will appear remotely through an online platform.
A plea conference has also been scheduled for first assistant director David Halls on March 8. Attorneys for both Baldwin and Gutierrez-Reed have indicated an intention to fight the charges.

Shortly after the charges were first announced, Luke Nikas, an attorney for Alec Baldwin, released a statement, saying, “This verdict distorts the tragic death of Halyna Hutchins and represents a horrific miscarriage of justice. Mr. Baldwin had no reason to believe there were live rounds in the gun — or anywhere else on the film set.”
“He relied on the professionals he worked with, who assured him the weapon had no live ammunition,” Nikas continued. “We will fight these charges, and we will win.”

Hannah Gutierrez-Reed’s attorney, Jason Bowles, also released a statement, saying, “Hannah is, and always has been, very emotional and sad about this tragic accident. But he didn’t commit an involuntary manslaughter.”
“These allegations are the result of a deeply flawed investigation, and an inaccurate understanding of the full facts,” Bowles added. “We intend to reveal the full truth and believe Hannah will be acquitted by a jury.”
Santa Fe DA Says Alec Baldwin Acted In ‘Careless Manner’ On Set

In a court filing Tuesday, provided by Deadline, the Santa Fe County District Attorney believes that Baldwin acted in a “negligent manner,” leading to the charges against him.
The document alleges that the gun Baldwin was holding on set was not properly inspected, leading to the fatal shooting. They also contend that safety issues on the set of “Rust” were not addressed, claiming that Baldwin did not take required safety training, and continued to point a gun at someone on set, which they maintain should not have happened.

The filing states that “On the day of the shooting alone, the evidence shows that no fewer than a dozen acts, or negligent omissions, occurred in the short time between lunch and the time of the shooting, and this does not include the reckless handling of a firearm by Baldwin.”
The court document goes on to say that “Baldwin, through actions or omissions or failure to act in his capacity as publisher directly contributed and/or failed to mitigate numerous reckless and dangerous actions in a very short period of time.”

“Finally, industry standards, protocols and common firearms safety procedures on film sets require the armorer, after conducting a safety check with the first assistant director, to conduct a second safety check with the actor who will be handling the firearm,” the court documents. say “These reckless violations of firearm safety and standards occurred two (2) times prior to the shooting, and Baldwin failed to act to mitigate or correct the reckless safety violations, either in his capacity as actor or producer.”

Baldwin acted with willful disregard for the safety of others and in a manner that endangered others and he clearly should have known the dangers of his actions that led to Hutchins’ death. Furthermore, Baldwin handled the weapon in a careless manner.”
