Yang began a long legal battle to take control of his estate. After a months-long legal battle, a judge finally ruled that Homer will be declared the general administrator of her estate instead of Anne’s ex, James Tupper, 57.

Judge Lee Bogdanoff ruled in November 2022 that Homer would take legal control of Heche’s remaining assets despite Tupper’s objections. Homer’s attorney, Bryan Phipps, released a brief statement after the hearing, saying they were happy to put this “phase” behind them.

“We believe the court reached the right decision this morning, legally and fairly, and are happy that this phase of the process is behind us,” he said. “With Mr. Tupper’s allegations and objections now resolved, we hope the administration of the Farm can continue without unnecessary complications.”

However, Judge Bogdanoff warned that Homer could be removed as administrator if the court finds any evidence of fraud or malfeasance. This warning most likely came from Tupper’s claim that over $200,000 worth of jewelry was missing. At the time, Judge Bogdanoff found no evidence of wrongdoing on behalf of Anne’s son.

The decision comes more than a month after Homer was granted “special powers” of his estate. According to court documents filed at the time, Homer was allowed to “take possession of all personal property of the decedent’s estate and preserve it from damage, waste, and injury.” He was also given copies of his financial records and personal tax returns.

Court filings state that Homer can now “initiate and maintain or defend” a potential lawsuit against the estate, which puts him in a position to address the latest lawsuit filed by Citibank over his alleged unpaid credit card debt.

Homer filed papers to take control of his mother’s estate in September, about a month after she died. Homer claims that his mother did not have a will, although Tupper said that the “13 Minutes” actor named him a will more than ten years ago. Homer had argued that his mother’s signature on the will was invalid, and apparently a judge agreed.
