Brian Laundrie’s Estate Owes MILLIONS To Gabby Petito’s Family!

Gabby Petito’s family has a million reasons, actually several million, to celebrate.

Even though their daughter is no longer alive, Nichole Schmidt and Joseph Petito make sure to get justice for Gabby.

A judge in Sarasota County, Florida ruled on Thursday, November 17, in favor of Gabby’s family in a wrongful death lawsuit against Brian Laundrie’s estate.

Gabby’s mother was awarded $3 million as administrator of Petito’s estate.

On Friday, May 13, Schmidt filed a new wrongful death lawsuit in Florida against the curator of Laundrie’s estate, according to Fox News.

Per the outlet, the lawsuit seeks wrongful death damages of at least $30,000.

It stated that Brian intentionally killed Gabby, and also demanded a trial by jury and judgment for compensatory damages.

“Petito’s family lost their daughter, and they were also denied the opportunity to confront her killer,” Patrick Reilly, an attorney for Petito’s parents, said in a statement to CNN. “There is no amount of money to compensate the Petito family for the loss of their daughter, Gabby, at the hands of Brian Laundrie. Brian doesn’t have $3 million; it is an arbitrary number. Whatever money they receive will help Gabby’s family in their efforts with the Gabby Petito Foundation.”

A trial in the wrongful-death lawsuit was scheduled for December; however, that won’t happen again, according to Reilly.

No Trial Will Take Place

“Joseph Petito and Nichole Schmidt wanted to turn their personal tragedy into something positive. It is their hope that Gabby’s foundation will bring these important issues to the public eye for the benefit of all of our communities,” their family attorney said.

When the lawsuit was initially filed, legal documents stated Gabby and Brian “became engaged on or about July 2, 2020. On July 2, 2021, Brian Laundrie and Gabrielle Petito left New York in a van owned by Gabrielle Petito to take a trip to western United States which is expected to last for several months.”

Schmidt’s last interaction with his daughter was on August 27, 2021.

“It is believed that on August 27, 2021, Brian Laundrie killed Gabrielle Petito. The cause of death was blunt force trauma to the head and neck by manual strangulation,” the complaint continued. “As a direct and proximate result of Brian Laundrie’s misconduct, Nichole Shcmidt and Joseph Petito incurred funeral and burial expenses, and they have suffered a loss of care and comfort, and have suffered a loss of friendship, society and future comfort.

Petito and Schmidt have also filed a wrongful death suit against Brian’s parents, Chris and Roberta Laundrie.

The lawsuit alleges Brian’s parents knew more about Gabby’s death than they let on.

Brian’s parents filed a motion to dismiss Petito-Schmidt’s original claim.

Judge Hunter W. Carroll denied Laundrie’s motion following an amendment to the original lawsuit filed by Gabby’s parents.
