US Capitol Police said Thursday they would not charge two men who filmed themselves having gay sex in a Senate Judiciary Committee hearing room last year.
“After consulting with federal and local prosecutors, as well as conducting a comprehensive investigation and review of possible charges, it has been determined that — despite the possible violation of Congressional policy — there is currently no evidence that a crime has been committed,” the USCP said in a statement.
One of the men involved has been identified as Aidan Maese-Czeropski, Sen’s staff. Ben Cardin (D-Md.) who was fired after the video of the attempt began circulating on social media.
Maese-Czeropski exercised his Fifth Amendment right against self-incrimination during the investigation, according to Capitol Police.
“Both persons of interest are not cooperating, nor are elements of any crime that may be found,” the statement added. “Our investigators are prepared to review new evidence should any come to light.”

The roughly eight seconds of recorded intercourse, first reported by the Spectator, were recorded in the same room where the Supreme Court nominee was being questioned by lawmakers.
The activity appears to be in clear violation of DC law, which prohibits “a person, in public, to make obscene or indecent exposure of his genitals or anus, to engage in masturbation, or to engage in sexual acts.”
The obscene meeting seems to have happened near where Sens. Amy Klobuchar (D-Minn.) and Chris Coons (D-Del.) sat down for markups just before the tape went down.

Following the spread of amateur porn clips, Semafor reported that in 2022, a top staff member for Rep. Dan Newhouse (R-Wash.) has come under scrutiny over allegations of “inappropriate behavior” circulated on Snapchat.
In the end, no “conclusive evidence” was found.
Maese-Czeropski was previously featured in an ad for President Biden during the 2020 campaign.

“This is a difficult time for me, because I have been attacked because people I love to pursue a political agenda. Although some of my actions in the past have shown poor judgment [sic]I love my job and would never disrespect my workplace,” the former employee wrote on LinkedIn last year.
“Any attempt to characterize my actions otherwise is a fabrication and I will explore the legal options available to me in this matter.”
Maese-Czeropski did not immediately respond to a request for comment on Thursday.
