Cardi B Wants To Keep Her Stripping Past Out Of Assault Jury Trial

Cardi B wants to avoid her past from a lawsuit involving an alleged assault on an LA security guard.

As The Blast previously reported, the “WAP” rapper has been sued by a security guard who claims he assaulted her in Los Angeles. Cardi B insisted that action was “reasonably necessary” to protect herself from “attacks” that occurred in 2018.

According to new court documents obtained by The Blast, Cardi B, born Belcalis Marlenis Almanzar, expected that the security guard, a woman named Emani Ellis, would try to turn the jury against her by including an argument based on Cardi B’s character that she was heard from a “third party.”

There was another alleged altercation between Cardi B and another person that she feared Ellis would take to court. He also worries about the possibility of criminal charges or police reports being used against him, as well as the use of “obscenity” he uses against others and in his music.

Cardi B is not only afraid that Ellis will use her lyrics against her, but she is also worried about her alleged drug use, her past as an exotic dancer, and media reports and other legal actions to try to smear her character and make the jury question her morals.

In a court filing, Cardi B stated that the alleged incident is “inadmissible character evidence, has no probative value, would be unduly prejudicial. [Cardi B], and there is no need to waste the court’s time and resources.” He went on to say that there may be no truth to the other allegations that Ellis plans to use against him, saying that it is “hearsay that cannot be accepted.”

According to court documents obtained by The Blast, the alleged encounter is said to have taken place for no more than sixty to ninety seconds at a time on Saturday, February 24, 2018. Cardi B, who was pregnant at the time, was visiting her obstetrician’s office for a scheduled appointment. Emani Ellis had worked as a security guard for the shoot.

It’s unclear what prompted Ellis to start shooting Cardi B; however, the “Be Careful” rapper said that she asked security guards to put down her phone and stop filming her, as her pregnancy was not public knowledge at the time.

It’s not clear how it happened, but Ellis claims Cardi B “scratched him with her fingernails, screamed racial slurs at him and spit on him.” Despite this, Ellis did not have a photo of the alleged injuries. He had no written documents to show that he reported the incident. He also did not seek any medical treatment for the scratch, according to court documents.

However, Ellis claims that he suffered “physical, emotional and psychological damage” as a result of the alleged brief altercation. In addition, the security guard also claimed to have a “scar” on his cheek from the incident which Cardi B noted was “invisible” in the court filing.

Cardi B has filed to keep the legal case between them limited to the above facts and does not want security guards to try to bring claims from third parties, also known as hearsay, into the trial to try to degrade her character.

The “Up” rapper claims that any other allegations that Ellis may try to use against him are “very prejudicial and a transparent and unwarranted attempt to throw. [Cardi B] in a bad view based on extraordinary things.”

He went on to say that he believed that there was “a serious danger that the jury would believe, based largely on hearsay evidence, that because [Cardi B] may have acted and/or been alleged to have acted in a certain way at different times and places involving different people” that a jury might conclude that he was a “bad person” and “seek to punish him improperly.”

The filing goes on to say that adding such allegations to their case “would not only require an undue use of the court’s time on extraneous matters, but it would create a substantial danger of undue prejudice, confuse the issues and confuse the jury.”
