Legendary singer Cher’s request for conservatorship of her second child, Elijah Blue Allman, has been denied again.
During the trial of the case, a judge ruled in Elia’s favor, stating that there was not enough evidence to prove that he should be in a conservatorship.
This is the second time Cher’s request has been rejected, as she was previously told by the court for not serving her son’s papers properly before the case hearing on January 5.

On Monday, January 29, both mother and son were present for the hearing, although Cher appeared virtually.
During the hearing, Judge Jessica A. Uzcategui denied the “Believe” singer’s request, stating, “I don’t question the motivation behind Cher wanting [help] his son… however, I do not see sufficient evidence.”
Elijah’s trust fund will be distributed to him on February 1, and in his court filing, his mother has expressed deep concern about his ability to manage his finances.
Cher previously claimed that “that if such a distribution [of funds] If it were to be channeled directly to Elijah, the funds would immediately be spent on buying drugs, leaving Elijah with no assets to support himself and endangering his life.”
In the latest court hearing, Cher’s lawyer brought up the matter again, saying that Elijah was “surrounded by people who deny mental illness… we’re trying to avoid a situation where his life is at risk.”
Following the judge’s latest ruling, Elijah’s attorney released a statement stating that he was “thrilled that the court saw that he did not need a temporary conservatorship.” They also said that the 47-year-old was open to mediation with his mother.

After a hearing on January 5, Judge Uzcategui denied Cher’s request to immediately protect Elijah, stating that Cher’s attorney did not provide her son and his legal team with the necessary paperwork to give them enough time to present their case.
Elia himself has stated in a court filing obtained by Explosion that he was not properly served with papers, which would have given him and his attorney enough time to prepare for the first hearing of his conservatorship.
He stated that although he received an email about the petition, he ignored it because he was not sure of the sender’s address. Elijah also claimed that although he had received the email service, the time it was sent was too close to his court hearing date.
“Although I received email copies of several petitions and related documents on December 31, 2023, although I have received service by email that is not five court days before the hearing, and I have not yet received or reviewed the Confidential Additional Information that has been filed by [Cher],” court documents filed by Elijah read.

In his court filing, Elijah, a musician himself, stated that he was aware of his mother’s good intentions for him but insisted that he did not need her support.
Elia stated that she has been “clean and sober from illegal substances for over 90 days now and [is] fully capable and committed to managing money [he] receive quarterly from a trust left by [his] late father.”
He added, according to court documents: “While I understand that my mother, the proposed conservator, believes she has my best interests at heart, and I appreciate her love and support, I do not need her unsolicited help or support at this time. “

In addition to the current legal battle with his mother, Elijah was also recently denied a request to dismiss his divorce from his wife, Marienagela King. His reasoning appears to be based on a legal technicality because a temporary support order was in place, and the judge denied the request because of the temporary order.
Elijah, who filed for divorce from his wife in 2021, recently reunited with her amid an ongoing legal battle with his mother. The pair are now united against Cher, with King even appearing in court for Elijah’s latest trial.
