Criminal Attorney Believes Alec Baldwin Will Win ‘Rust’ Trial

Actor Alec Baldwin faces at least 18 months in prison if he is convicted of involuntary manslaughter in connection with the death of “Rust” cinematographer Halyna Hutchins.

In October 2021, the gun the “30 Rock” actor was holding exploded, seriously injuring Hutchins. Although charges were initially brought against him in January 2023, they were dropped a few months later pending further investigation.

Charges were refiled in January 2024, where the 65-year-old actor has pleaded not guilty. Although her trial won’t begin until July, the fatal shooting is once again making headlines because of the shield of Hannah Gutierrez-Reed, who is now on trial on charges of involuntary manslaughter and tampering with evidence.

Although Alec Baldwin’s trial doesn’t begin until later this summer, his name has come up numerous times in trials featuring Hannah Gutierrez-Reed’s “Rust” shield. Although the prosecution has tried to paint the new shield as unprofessional and sloppy, his lawyers have argued that he was used as a “scapegoat.”

Criminal trial attorney and “Death By Fame” expert Sara Azari told the Daily Mail on Thursday that she believes that Alec Baldwin will not face time behind bars and walk away a free man. Azari noted that the prosecution “obviously wants to make an example out of Alec Baldwin, but you want to go after that shield. That’s his job. It’s protocol that actors rely on the safety of the props given to them by those responsible for the safety of the props and that’s what he do.”

“[At the time of the shooting] the shield was gone and left the gun with the second director, the second director said the prop was a cool mean that was not loaded with live ammunition. And that’s not true,” he continued, although law enforcement officials have admitted that they still don’t know exactly how the live ammunition ended up on the movie set.

While it remains to be seen whether the prop gun used in the shooting will be presented during the armory’s trial, Azari called the case “shameful” after learning that the gun had been altered when the FBI took it in for testing.

“We have a big problem here because the gun is the smoking gun, literally, is evidence in this case, and the gun is no longer in the condition it was when it was fired at Halyna Hutchins,” Azari said. “You can’t bring in animation and convict someone with an altered gun, so it’s a very problematic case for the prosecution.”

“For you to stand in front of a jury as a prosecutor and try to show that what happened or how Alec Baldwin described what happened is not true, you need the gun provided that it was the right time he was holding it. hand whether you believe he pulled the trigger or not is a different story, but don’t be,” he continued, adding, “I feel very strongly that Baldwin is going to win.”

While Azari believes that the jury will find Alec Baldwin innocent, the same cannot be said for Hannah Gutierrez-Reed’s shield.

“Shield has an absolute legal obligation. He was criminally negligent in failing to perform that duty. He really, in my opinion, should be found guilty of involuntary manslaughter which is criminal negligence,” Azari said. “But Baldwin doesn’t. Baldwin should have been tried, but I don’t see 12 jurors unanimously finding him guilty based on these facts.”

Earlier in the trial, jurors were shown text messages between Hannah Gutierrez-Reed and a crew member, making it seem like she had smoked to “get high” the night before the fatal shooting, which took place on October 21, 2021.

On October 20, he sent a text message saying, “LOL. I don’t need that tonight anyway. I might be smoking in the jacuzzi soon. I pooped a lot.” The message didn’t say what he was smoking; however, the next text message said he was heading down to get back up high.”

Prosecutors charged Hannah Gutierrez-Reed with tampering with evidence last summer after a witness came forward to claim she had handed over a bag of cocaine the day Halyna Hutchins was killed, hindering the police investigation.

Prosecutors allege that his drug and alcohol use the night after the shooting was wrapped up for the day impaired his judgment and may have left him unable to tell a live round from a dummy round on the day of the fatal shooting.

However, his legal team blamed Alec Baldwin’s reckless handling of a weapon on set for the cinematographer’s death. His lead attorney, Jason Bowles, has accused police of unfairly targeting shields after the shooting.
