Delta hit with suit for ‘over-serving’ booze to husband who fatally ran over wife after flight

Delta Airlines has been sued for allegedly overdosing a husband who killed his wife in a Utah airport parking lot after a flight.

Representatives for the estate of slain mother Charlotte Sturgeon and her son – who witnessed the horrific crash – said in a lawsuit filed Friday that the airline was to blame for her tragic death because its employees served at least two extra drinks to Shawn Sturgeon’s husband even though he take it “multiple” alcoholic drinks before boarding the plane, according to a report by the Salt Lake Tribune.

The trio had been on a flight from vacation in San Antonio to Salt Lake City before the April 4, 2022 incident that occurred on the second level of the short-term parking garage at Salt Lake International Airport.

The drink the crew served him, “had intoxicated Shawn to a level above the legal blood alcohol limit, causing him to be impaired,” and he had no recollection of landing or going to the car, the suit alleges.

Once in the parking garage, Shawn argued so “loudly and violently” with his wife that bystanders were “uncomfortable,” the outlet reported, citing criminal court papers from the time.

Shawn then got into the driver’s seat of the SUV and backed up, dragging Charlotte – who was outside the open right rear door where her son was sitting – and causing her to fall under the vehicle.

He then drove off and hit his wife for about 10 feet before finally stopping, the news site reported, citing criminal court papers and surveillance footage.

Shawn continued to scold his wife as soon as he got out of the car saying “Are you f–ing crazy” and “Get up f–k up now. Get off the ground and get into the car.” He put her in the car and drove to a toll booth where she asked for help.

Charlotte was unresponsive when police arrived and was later pronounced dead at the hospital.

Shawn’s blood alcohol level was three times the legal limit at the time.

The husband was sentenced to 20 years in prison in September 2022 after he pleaded guilty to vehicular homicide and domestic violence with a child in September 2022, ABC4 reported.

Delta should have known Shawn was heavily intoxicated when he left the plane, however, employees “took no steps” to ensure he was not behind the wheel or notify police, the outlet reported, citing the suit.

The airline’s negligence was “wilful, willful, reckless, [and] wanton” and it cares more about making money “than continuing to sell” drinks to people “who are clearly intoxicated,” the filing alleges.

And Sturgeon’s son now suffers from emotional distress and psychological illness, the suit alleges.

The suit was filed by Denise Marie Nimtz, the child’s legal guardian and by Joseph Dalton who represents the estate with Nimtz.

Delta did not immediately return a request for comment on Monday. But the airline told the Salt Lake Tribune: “While we dispute the allegations in the complaint, we cannot comment further on pending litigation.”
