EBay to pay $59M over alleged pill presses used to make fentanyl-laced counterfeit drugs

EBay agreed to pay $59 million and improve its compliance program to resolve Justice Department allegations it didn’t do enough to stop criminals from buying devices to make counterfeit drugs.

Wednesday’s settlement is the Justice Department’s first with an e-commerce company for violating the federal Controlled Substances Act, which regulates the manufacture and distribution of drugs.

It arose from eBay’s monitoring of thousands of pill presses and packaging machines sold through its website.

The Justice Department says criminals can use pill presses and packaging machines to illegally manufacture counterfeit pills, including the fentanyl-laced pills that are helping fuel the nation’s opioid epidemic.

EBay is accused of failing to comply with recordkeeping and reporting requirements, including verification of the buyer’s identity, to the US Drug Enforcement Administration for the devices, which include a press capable of producing thousands of pills per hour.

Many buyers of the pill machines were later charged with drug-related crimes, the Justice Department said.

“Fentanyl — pressed into fake pills that look like real prescription drugs — is killing Americans,” DEA Administrator Anne Milgram said in a statement. “EBay and other e-commerce platforms must do their part to protect the public.”

EBay did not immediately respond to a request for comment.
